  1.1                          A bill for an act
  1.2             relating to human services; modifying prior 
  1.3             authorization for medical assistance; amending 
  1.4             Minnesota Statutes 2002, section 256B.0625, 
  1.5             subdivision 25. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 256B.0625, 
  1.8   subdivision 25, is amended to read: 
  1.9      Subd. 25.  [PRIOR AUTHORIZATION REQUIRED.] (a) The 
  1.10  commissioner shall publish in the State Register a list of 
  1.11  health services that require prior authorization, as well as the 
  1.12  criteria and standards used to select health services on the 
  1.13  list.  The list and the criteria and standards used to formulate 
  1.14  it are not subject to the requirements of sections 14.001 to 
  1.15  14.69.  The commissioner's decision whether prior authorization 
  1.16  is required for a health service is not subject to 
  1.17  administrative appeal. 
  1.18     (b) Prior authorization is not required for individuals 
  1.19  receiving physical therapy or occupational therapy and related 
  1.20  services, including specialized maintenance therapy, if the 
  1.21  physical therapy, occupational therapy, or related services are 
  1.22  provided:  (1) in conjunction with social services; and (2) at a 
  1.23  center where at least 95 percent of the individuals served are 
  1.24  diagnosed with multiple sclerosis. 
  1.25     [EFFECTIVE DATE.] This section is effective July 1, 2004.
