  1.1                          A bill for an act 
  1.2             relating to public safety; imposing fine surcharge on 
  1.3             traffic violators apprehended by state patrol; 
  1.4             creating trooper training account; appropriating 
  1.5             money; amending Minnesota Statutes 2000, sections 
  1.6             169.89, by adding a subdivision; 299D.03, subdivision 
  1.7             6, by adding a subdivision; Minnesota Statutes 2001 
  1.8             Supplement, section 299D.03, subdivision 5. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2000, section 169.89, is 
  1.11  amended by adding a subdivision to read: 
  1.12     Subd. 4a.  [SURCHARGE.] A person who violates a traffic or 
  1.13  motor vehicle law, and who was apprehended or arrested by an 
  1.14  officer of the state patrol, shall be assessed $25 in addition 
  1.15  to the fine otherwise imposed for the violation. 
  1.16     Sec. 2.  Minnesota Statutes 2001 Supplement, section 
  1.17  299D.03, subdivision 5, is amended to read: 
  1.18     Subd. 5.  [FINES AND FORFEITED BAIL MONEY.] (a) Except for 
  1.19  the surcharge assessed under section 169.89, subdivision 4a, all 
  1.20  fines and forfeited bail money, from traffic and motor vehicle 
  1.21  law violations, collected from persons apprehended or arrested 
  1.22  by officers of the state patrol, shall be paid by the person or 
  1.23  officer collecting the fines, forfeited bail money or 
  1.24  installments thereof, on or before the tenth day after the last 
  1.25  day of the month in which these moneys were collected, to the 
  1.26  county treasurer of the county where the violation occurred.  
  1.27  Three-eighths of these receipts shall be credited to the general 
  2.1   revenue fund of the county, except that in a county in a 
  2.2   judicial district under section 480.181, subdivision 1, 
  2.3   paragraph (b), this three-eighths share must be transmitted to 
  2.4   the state treasurer for deposit in the state treasury and 
  2.5   credited to the general fund.  The other five-eighths of these 
  2.6   receipts shall be transmitted by that officer to the state 
  2.7   treasurer and must be credited to the trunk highway fund.  If, 
  2.8   however, the violation occurs within a municipality and the city 
  2.9   attorney prosecutes the offense, and a plea of not guilty is 
  2.10  entered, one-third of the receipts shall be credited to the 
  2.11  general revenue fund of the county, one-third of the receipts 
  2.12  shall be paid to the municipality prosecuting the offense, and 
  2.13  one-third shall be transmitted to the state treasurer as 
  2.14  provided in this subdivision.  All costs of participation in a 
  2.15  nationwide police communication system chargeable to the state 
  2.16  of Minnesota shall be paid from appropriations for that purpose. 
  2.17     (b) Notwithstanding any other provisions of law, all fines 
  2.18  and forfeited bail money from violations of statutes governing 
  2.19  the maximum weight of motor vehicles, collected from persons 
  2.20  apprehended or arrested by employees of the state of Minnesota, 
  2.21  by means of stationary or portable scales operated by these 
  2.22  employees, shall be paid by the person or officer collecting the 
  2.23  fines or forfeited bail money, on or before the tenth day after 
  2.24  the last day of the month in which the collections were made, to 
  2.25  the county treasurer of the county where the violation 
  2.26  occurred.  Five-eighths of these receipts shall be transmitted 
  2.27  by that officer to the state treasurer and shall be credited to 
  2.28  the highway user tax distribution fund.  Three-eighths of these 
  2.29  receipts shall be credited to the general revenue fund of the 
  2.30  county, except that in a county in a judicial district under 
  2.31  section 480.181, subdivision 1, paragraph (b), this 
  2.32  three-eighths share must be transmitted to the state treasurer 
  2.33  for deposit in the state treasury and credited to the general 
  2.34  fund. 
  2.35     (c) Money collected by virtue of the surcharge assessed 
  2.36  under section 169.89, subdivision 4a, shall be paid by the 
  3.1   person collecting the surcharge to the state treasurer, who 
  3.2   shall credit it to the trooper training account created in 
  3.3   subdivision 6a. 
  3.4      Sec. 3.  Minnesota Statutes 2000, section 299D.03, 
  3.5   subdivision 6, is amended to read: 
  3.6      Subd. 6.  [TRAINING PROGRAM.] The commissioner of public 
  3.7   safety may provide training programs for the purpose of 
  3.8   obtaining qualified personnel for the state patrol. Persons 
  3.9   accepted by the commissioner of public safety for training under 
  3.10  this training program shall be designated state patrol trainees 
  3.11  and shall receive a salary not to exceed 70 percent of the basic 
  3.12  salary for patrol officers as prescribed in subdivision 2, 
  3.13  during the period of the training.  Nothing contained in this 
  3.14  subdivision shall be construed to prevent the commissioner of 
  3.15  public safety from providing in-service training programs for 
  3.16  state patrol officers.  The commissioner of transportation shall 
  3.17  furnish the commissioner of public safety with lands and 
  3.18  buildings necessary in providing in-service training programs 
  3.19  and the department of public safety shall reimburse the 
  3.20  department of transportation for all reasonable costs incurred 
  3.21  due to the provision of these training facilities.  All costs 
  3.22  related to in-service training programs for existing state 
  3.23  patrol troopers shall first be paid by the commissioner from 
  3.24  money in the trooper training account created in subdivision 6a 
  3.25  to the extent that funds are available in the account. 
  3.26     Sec. 4.  Minnesota Statutes 2000, section 299D.03, is 
  3.27  amended by adding a subdivision to read: 
  3.28     Subd. 6a.  [TROOPER TRAINING ACCOUNT.] A trooper training 
  3.29  account is created in the special revenue fund.  The account 
  3.30  receives surcharges credited under subdivision 5 and other money 
  3.31  as specified by law.  All funds in the account are annually 
  3.32  appropriated to the commissioner of public safety to be used for 
  3.33  in-service training programs for existing state patrol 
  3.34  troopers.  The commissioner, as part of the department's 
  3.35  biennial budget, shall provide information on revenues deposited 
  3.36  in the account, past and proposed uses of the account, and the 
  4.1   available account balance.
