  1.1                          A bill for an act 
  1.2             relating to appropriations; reinstating the beaver 
  1.3             damage control grant program; appropriating money; 
  1.4             proposing coding for new law in Minnesota Statutes, 
  1.5             chapter 103B. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section. 1.  [103B.160] [BEAVER DAMAGE CONTROL GRANTS.] 
  1.8      Subdivision 1.  [ESTABLISHMENT.] The Board of Water and 
  1.9   Soil Resources shall establish a beaver damage control grant 
  1.10  program to provide grants for the control of beaver activities 
  1.11  causing damage to public waters, roads, and ditches and adjacent 
  1.12  private property.  The grants may only be made to a joint powers 
  1.13  board established under section 471.59 by two or more 
  1.14  governmental units and may include Indian tribal governments. 
  1.15     Subd. 2.  [GRANT AMOUNT.] The board may provide up to 50 
  1.16  percent of the costs of implementing a beaver damage control 
  1.17  program by a joint powers board. 
  1.18     Subd. 3.  [AWARDING OF GRANTS.] Applications for grants 
  1.19  must be made to the board on forms prescribed by the 
  1.20  commissioner.  The board shall consult with town supervisors and 
  1.21  county commissioners representing different areas of the state 
  1.22  in developing the application form.  A joint powers board 
  1.23  seeking a grant may be required to supply information on the 
  1.24  beaver control program it has adopted, the extent of the problem 
  1.25  in the geographic area covered by the joint powers agreement, 
  2.1   and the ability of the joint powers board to match the state 
  2.2   grant.  The board may prioritize the grant applications based 
  2.3   upon the information requested as part of the grant application. 
  2.4      Subd. 4.  [REPORT.] (a) Within one year after receiving a 
  2.5   grant under this section, a joint powers board must report to 
  2.6   the Board of Water and Soil Resources on the joint powers 
  2.7   board's efforts to control beaver in the area. 
  2.8      (b) The board shall report to the senate and house 
  2.9   environment and natural resources policy and finance committees 
  2.10  on the efforts under this section to control beaver by December 
  2.11  15 of each even-numbered year. 
  2.12     Sec. 2.  [APPROPRIATION.] 
  2.13     $....... is appropriated from the general fund for fiscal 
  2.14  year 2005 to the Board of Water and Soil Resources for beaver 
  2.15  damage control grants under section 1.
