A bill for an act
relating to health; requiring health maintenance organizations to participate in the
commercial market to the same extent they serve state health program enrollees;
amending Minnesota Statutes 2016, section 62D.04, by adding a subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2016, section 62D.04, is amended by adding a subdivision
to read:

Health maintenance organizations shall,
as a condition of receiving and retaining a certificate of authority, offer at least one individual
health plan in the individual market, in each county or geographic area in the state in which
it provides health coverage to medical assistance or MinnesotaCare enrollees. For purposes
of this subdivision, "individual health plan" has the meaning provided in section 62A.011,
subdivision 4, and "individual market" has the meaning provided in section 62A.011,
subdivision 5.

This section is effective January 1, 2018, and applies to health
plans issued, offered, or renewed on or after that date.
