  1.1                          A bill for an act 
  1.2             relating to local government; authorizing Sherburne 
  1.3             county to divide a county ditch without a 
  1.4             redetermination of benefits. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [SHERBURNE COUNTY; DIVISION OF COUNTY DITCH 
  1.7   WITHOUT REDETERMINATION.] 
  1.8      Subdivision 1.  [ORDER.] The board of commissioners of 
  1.9   Sherburne county may by order, after notice and a public 
  1.10  hearing, divide County Ditch number 28 into two separate county 
  1.11  ditch systems without the necessity of a redetermination of 
  1.12  benefits. 
  1.13     Subd. 2.  [PROCEDURE FOR APPORTIONING BENEFITS AFTER 
  1.14  DIVISION.] The county auditor shall assign a percentage to each 
  1.15  property on the undivided County Ditch number 28 based upon the 
  1.16  benefits received, with the total equaling 100 percent.  The 
  1.17  auditor shall recalculate these same percentages for each 
  1.18  benefited property on the newly divided ditches so that each 
  1.19  property continues to have the same proportionate burden to the 
  1.20  newly divided ditch that it had prior to the division.  The 
  1.21  newly divided ditches must be numbered as County Ditch number 
  1.22  128 and County Ditch number 28. 
  1.23     Subd. 3.  [EFFECT OF DIVISION.] The division authorized by 
  1.24  this section does not effect or release any existing ditch lien 
  1.25  or assessment made or pending against the benefited properties. 
  2.1      Sec. 2.  [EFFECTIVE DATE.] 
  2.2      This act is effective the day following final enactment.
