  1.1                          A bill for an act 
  1.2             relating to corrections; authorizing Dakota county to 
  1.3             require inmates in county jail to contribute to the 
  1.4             costs of incarceration; amending Minnesota Statutes 
  1.5             2000, section 641.12, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 641.12, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 3.  [INMATE PAYMENT OF ROOM AND BOARD IN DAKOTA 
  1.10  COUNTY.] The Dakota county board of commissioners may require 
  1.11  that each person who is booked for confinement at the county 
  1.12  jail, and not released upon completion of the booking process, 
  1.13  pay to the Dakota county sheriff's department part of the cost 
  1.14  of their board, room, clothing, medical, dental, and other 
  1.15  correctional services.  If the county board exercises this 
  1.16  authority, the county must not impose the fee authorized by 
  1.17  subdivision 1.  The costs may be deducted from any money then 
  1.18  possessed by the person being booked, any money deposited with 
  1.19  the sheriff's department on the person's behalf, or any earnings 
  1.20  of the person.  If the person has inadequate funds at the time 
  1.21  of booking to pay for these costs, the sheriff shall notify the 
  1.22  district court in the county where the charges related to the 
  1.23  booking are pending, and shall request the assessment of the 
  1.24  costs.  Notwithstanding section 609.10 or 609.125, upon 
  1.25  notification from the sheriff, the district court must order the 
  2.1   costs paid to the sheriff's department as part of any sentence 
  2.2   or disposition imposed.  If the person is not charged, is 
  2.3   acquitted, or if the charges are dismissed, the sheriff shall 
  2.4   return the costs previously paid to the person at the last known 
  2.5   address listed in the booking records.  A person who is indigent 
  2.6   must not be assessed these costs.
