A bill for an act
relating to taxation; exempting certain energy saving products from the sales
and use tax; amending Minnesota Statutes 2004, section 297A.67, by adding a
subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2004, section 297A.67, is amended by adding a
subdivision to read:

new text begin (a) The following products are exempt:

new text begin (1) programmable thermostats;
new text end

new text begin (2) weatherstripping;
new text end

new text begin (3) insulation;
new text end

new text begin (4) residential lighting fixture or a compact fluorescent bulb, if it has an energy
star label;
new text end

new text begin (5) an electric heat pump hot water heater with an energy factor of at least 1.9;
new text end

new text begin (6) a natural gas water heater with an energy factor of at least 0.62;
new text end

new text begin (7) a propane gas or fuel oil water heater with an energy factor of at least 0.62;
new text end

new text begin (8) a natural gas furnace with an annual fuel utilization efficiency greater than 92
percent; and
new text end

new text begin (9) a propane gas or fuel oil furnace with an annual fuel utilization efficiency
greater than 92 percent.
