A bill for an act
relating to energy; requiring Department of Commerce to prepurchase delivered
fuel in certain circumstances as part of low-income home energy assistance
program; proposing coding for new law in Minnesota Statutes, chapter 216C.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

PROGRAM; PREPURCHASE OF FUEL.

new text begin The commissioner of commerce, to the extent of available funds and as part of the
low-income home energy assistance program, shall engage in a program to prepurchase
delivered fuel in the months before the succeeding winter heating season. The purpose
of the program is to obtain lower unit prices for the delivered fuel. The commissioner
may decide to limit or not engage in prepurchasing if the commissioner finds that there
is a reasonable likelihood that prepurchasing will not provide fuel-cost savings. For the
purposes of this section, "delivered fuel" includes propane and number one and number
two fuel oils.
