  1.1                          A bill for an act 
  1.2             relating to municipalities; limiting tort liability 
  1.3             for geographic information systems information; 
  1.4             amending Minnesota Statutes 1998, section 466.03, by 
  1.5             adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 466.03, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 21.  [GEOGRAPHIC INFORMATION SYSTEMS (GIS) DATA.] (a) 
  1.10  Any claim against a municipality, based on alleged or actual 
  1.11  inaccuracies in geographic information systems data, arising 
  1.12  from the public's use of GIS data, if the municipality provides 
  1.13  a disclaimer of the accuracy of the information at any point of 
  1.14  initial contact with a geographic information system to which 
  1.15  the public has general access. 
  1.16     (b) Geographic information systems data is government data 
  1.17  subject to the presumption of section 13.01, subdivision 3.  GIS 
  1.18  data is data generated by a computer database or system that is 
  1.19  designed to electronically capture, organize, store, update, 
  1.20  manipulate, analyze, and display all forms of geographically 
  1.21  referenced information that is compiled, from private or public 
  1.22  sources, either alone or in cooperation with other public or 
  1.23  private entities, for use by a municipality.  GIS data is 
  1.24  accurate for its intended use by a municipality and may be 
  1.25  inaccurate for other uses. 
  2.1      Sec. 2.  [EFFECTIVE DATE.] 
  2.2      Section 1 is effective the day following final enactment 
  2.3   and applies to causes of action arising on or after that date.
