  1.1                          A bill for an act 
  1.2             relating to education; post-secondary enrollment 
  1.3             options; limiting enrollment in physical education 
  1.4             courses; amending Minnesota Statutes 2000, section 
  1.5             124D.09, subdivision 9. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 124D.09, 
  1.8   subdivision 9, is amended to read: 
  1.9      Subd. 9.  [ENROLLMENT PRIORITY.] A post-secondary 
  1.10  institution shall give priority to its post-secondary students 
  1.11  when enrolling 11th and 12th grade pupils in its courses.  A 
  1.12  post-secondary institution may provide information about its 
  1.13  programs to a secondary school or to a pupil or parent, but it 
  1.14  may not advertise or otherwise recruit or solicit the 
  1.15  participation on financial grounds, secondary pupils to enroll 
  1.16  in its programs.  An institution must not enroll secondary 
  1.17  pupils, for post-secondary enrollment options purposes, in 
  1.18  remedial, developmental, or other courses that are not college 
  1.19  level.  A post-secondary enrollment options pupil may enroll in 
  1.20  the institution's physical education courses only if the pupil 
  1.21  is concurrently enrolled in another course at the institution 
  1.22  through the post-secondary enrollment options program.  Once a 
  1.23  pupil has been enrolled in a post-secondary course under this 
  1.24  section, the pupil shall not be displaced by another student.
