A bill for an act
relating to game and fish; permitting a deer killed by a motor vehicle to be kept
by the driver; amending Minnesota Statutes 2008, section 97A.502.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 97A.502, is amended to read:


97A.502 DEER KILLED BY MOTOR VEHICLES.

new text begin (a) new text end Deer killed by a motor vehicle on a public road must be removed by the road
authority, as defined by section 160.02, subdivision 25new text begin , unless the driver of the motor
vehicle is allowed to possess the deer under paragraph (b)
new text end . The commissioner of natural
resources must provide to all road authorities standard forms for statistical purposes and
the tracking of wild animals.

new text begin (b) The driver of a motor vehicle that has collided with and killed a deer on a public
road has priority in possessing the entire deer if the facts at the collision scene indicate
that the deer was not taken illegally.
