A bill for an act
relating to health; providing colorectal cancer screening for the uninsured;
appropriating money; amending Minnesota Statutes 2006, section 256B.057,
by adding a subdivision; proposing coding for new law in Minnesota Statutes,
chapter 144.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Establishment. new text end

new text begin The commissioner shall develop and implement a
colorectal screening program to provide screening to uninsured and underinsured women
and men.

new text begin Subd. 2. new text end

new text begin Eligibility. new text end

new text begin To be eligible, an applicant must:
new text end

new text begin (1) be over 50 years of age or under the age of 50 and at high risk for colon cancer;
new text end

new text begin (2) be uninsured, have insurance that does not cover routine colorectal cancer
screenings, or be unable to pay the deductible or co-payment; and
new text end

new text begin (3) have a gross family income at or below 250 percent of the federal poverty level.

new text begin Services provided under this program shall include:
new text end

new text begin (1) colorectal cancer screening, according to standard practice of medicine;
new text end

new text begin (2) follow-up services for abnormal tests; and
new text end

new text begin (3) diagnostic services.
new text end

Sec. 2.

Minnesota Statutes 2006, section 256B.057, is amended by adding a
subdivision to read:

new text begin Certain persons needing treatment for colorectal cancer. new text end

new text begin (a) Medical
assistance may be paid for an individual who:
new text end

new text begin (1) has been screened for colorectal cancer through the colorectal cancer screening
program under section 144.929;
new text end

new text begin (2) according to the individual's treating health professional, needs treatment,
including diagnostic services necessary to determine the extent and proper course of
treatment, for colorectal cancer;
new text end

new text begin (3) has a gross family income at or below 250 percent of federal poverty guidelines;
new text end

new text begin (4) is under the age of 65;
new text end

new text begin (5) is not otherwise eligible for medical assistance, general assistance medical care,
or MinnesotaCare program; and
new text end

new text begin (6) is not otherwise covered under creditable coverage, as defined under United
States Code, title 42, section 139.60(aa).

new text begin (b) Medical assistance provided for an eligible individual under this subdivision
shall be limited to services provided during the period that the individual receives
treatment for colorectal cancer.

new text begin (c) An individual meeting the criteria in paragraph (a) is eligible for medical
assistance without meeting the eligibility criteria relating to income and assets in section
256B.056, subdivisions 1a to 5b.

Sec. 3. new text begin APPROPRIATION.

new text begin $....... is appropriated in fiscal year 2009 from the general fund to the commissioner
of health to implement the colorectal screening program established in Minnesota Statutes,
section 144.929.
