1.1 A bill for an act 1.2 relating to game and fish; requiring a license to sell 1.3 live bait; amending Minnesota Statutes 2002, section 1.4 97A.475, by adding a subdivision; proposing coding for 1.5 new law in Minnesota Statutes, chapter 97C. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 2002, section 97A.475, is 1.8 amended by adding a subdivision to read: 1.9 Subd. 25a. [LIVE BAIT RETAILER.] The fee for a live bait 1.10 retailer license is $15. 1.11 Sec. 2. [97C.392] [SELLING LIVE BAIT.] 1.12 Subdivision 1. [LICENSE REQUIRED.] A person may not sell 1.13 live bait at retail without a live bait retailer license. A 1.14 person must purchase a live bait retailer license for each live 1.15 bait retail outlet operated. 1.16 Subd. 2. [LICENSE APPLICATION.] (a) An applicant for a 1.17 live bait retailer license must give the business name and 1.18 address for the retail outlet. The address must include a 1.19 street address or fire number. 1.20 (b) The retail outlet name and location may be changed for 1.21 licensing purposes upon application to the commissioner. 1.22 Subd. 3. [EXEMPTIONS.] This section does not apply to: 1.23 (1) a person who possesses a minnow retailer license; or 1.24 (2) a resident under age 18 who sells leeches at retail.
