  1.1                          A bill for an act 
  1.2             relating to human services; decreasing the county 
  1.3             share of financial responsibility for precommitment 
  1.4             confinement costs for sexually dangerous persons and 
  1.5             persons with sexual psychopathic personalities; 
  1.6             appropriating money for reimbursements to counties for 
  1.7             these costs; amending Minnesota Statutes 2002, section 
  1.8             253B.185, subdivision 5.  
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2002, section 253B.185, 
  1.11  subdivision 5, is amended to read: 
  1.12     Subd. 5.  [FINANCIAL RESPONSIBILITY.] (a) For purposes of 
  1.13  this subdivision, "state facility" has the meaning given in 
  1.14  section 246.50. 
  1.15     (b) Notwithstanding sections 246.54, 253B.045, and any 
  1.16  other law to the contrary, when a petition is filed for 
  1.17  commitment under this section pursuant to the notice required in 
  1.18  section 244.05, subdivision 7, the state and county are each is 
  1.19  responsible for 50 90 percent of the cost of the person's 
  1.20  confinement at a state facility or county jail, prior to 
  1.21  commitment.  The county is responsible for the remaining ten 
  1.22  percent.  
  1.23     (c) The county shall submit an invoice to the state court 
  1.24  administrator for reimbursement of the state's share of the cost 
  1.25  of confinement. 
  1.26     (d) Notwithstanding paragraph (b), the state's 
  1.27  responsibility for reimbursement is limited to the amount 
  2.1   appropriated for this purpose. 
  2.2      Sec. 2.  [APPROPRIATIONS.] 
  2.3      Subdivision 1.  [HUMAN SERVICES.] $....... is appropriated 
  2.4   to the commissioner of human services from the general fund for 
  2.5   the fiscal year ending June 30, 2005, for grants to counties for 
  2.6   reimbursement of precommitment confinement costs incurred 
  2.7   between July 1, 2003, and June 30, 2004, involving persons 
  2.8   petitioned as being sexually dangerous or having a sexual 
  2.9   psychopathic personality.  
  2.10     Subd. 2.  [STATE COURT ADMINISTRATOR.] $....... is 
  2.11  appropriated to the state court administrator from the general 
  2.12  fund for the fiscal year ending June 30, 2005, for 
  2.13  reimbursements to counties under Minnesota Statutes, section 
  2.14  253B.185, subdivision 5.
