A bill for an act
relating to education; providing for English learners with interrupted formal
education; amending Minnesota Statutes 2012, section 124D.59, by adding a
subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2012, section 124D.59, is amended by adding a
subdivision to read:

(a) "English
learner with interrupted formal education" means an English learner who meets the
following requirements:

(1) the pupil comes from a home where the language usually spoken is other than
English or usually speaks a language other than English;

(2) the pupil enters school in the United States after grade 6;

new text begin
(3) the pupil has at least two years less schooling than peers;
new text end
new text begin
(4) the pupil functions at least two years below expected grade level in reading
and mathematics; and

(5) the pupil may be preliterate in the pupil's native language.

(b) Notwithstanding section 120A.20, subdivision 1, a pupil who meets the
requirements of paragraph (a) must be counted as an English learner in calculating English
learner pupil units under section 126C.05, subdivision 17, and shall generate state English
learner aid under section 124D.65, subdivision 5, until the end of the school year when
the student becomes 23 years old.
