  1.1                          A bill for an act 
  1.2             relating to juveniles; providing a temporary 
  1.3             moratorium on licensing of dispositional residential 
  1.4             beds; requesting the legislative audit commission to 
  1.5             study juvenile out-of-home placements. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [MORATORIUM ON LICENSING.] 
  1.8      Effective May 1, 1998, the commissioners of corrections and 
  1.9   human services may not grant a request for new licensed 
  1.10  dispositional residential treatment facilities for juveniles 
  1.11  that house more than 20 juveniles at a time. 
  1.12     Sec. 2.  [JUVENILE OUT-OF-HOME PLACEMENT STUDY.] 
  1.13     The legislative audit commission is requesting the auditor 
  1.14  to conduct a study of the types of services or additional beds 
  1.15  needed for residential treatment programs for juveniles.  The 
  1.16  study must include: 
  1.17     (1) a determination of which juveniles are being placed out 
  1.18  of home; 
  1.19     (2) an analysis of the reasons for out-of-home placements; 
  1.20     (3) an examination of where out-of-home placements occur, 
  1.21  including the diverse types of placements available; 
  1.22     (4) an assessment of what services are provided for 
  1.23  juveniles in out-of-home placements; 
  1.24     (5) a determination of the average length of stay of 
  1.25  juveniles in out-of-home placements; 
  2.1      (6) a determination of the rates for juvenile out-of-home 
  2.2   placements and the reasons for noncompletion; 
  2.3      (7) an evaluation of the reasons certain juveniles failed 
  2.4   to complete out-of-home placements; 
  2.5      (8) an estimate of the cost of out-of-home juvenile 
  2.6   placements; 
  2.7      (9) evaluation of the effectiveness of juvenile out-of-home 
  2.8   placements based upon evaluation of the status of a juvenile's 
  2.9   after-out-of-home placement; 
  2.10     (10) an evaluation of the utilization of continuum of care; 
  2.11  and 
  2.12     (11) an evaluation in the gaps in services provided for 
  2.13  juvenile out-of-home placements and the need for additional beds 
  2.14  for the juvenile out-of-home placement population. 
  2.15     If the commission directs the auditor to conduct this 
  2.16  study, the auditor shall report findings to the chairs of the 
  2.17  house and senate committees and divisions with jurisdiction over 
  2.18  juvenile out-of-home placements by January 15, 1999.
