A bill for an act
relating to capital investment; authorizing spending to acquire and better public
land and buildings and other improvements of a capital nature; authorizing
the issuance of state bonds; appropriating money for construction of a water
reclamation facility in Faribault.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

new text begin $8,676,000 is appropriated from the bond proceeds
fund to the commissioner of the Pollution Control Agency for a grant to the city of
Faribault to predesign, design, construct, furnish, and equip the upgrade to the city's water
reclamation facility required by the mediated agreement between the Minnesota Pollution
Control Agency and the Minnesota Center for Environmental Advocacy requiring the
city of Faribault to meet a 1 mg/L phosphorus discharge by December 31, 2010. The
upgrade is also to meet a pending ammonia discharge limit and more stringent phosphorus
discharge limits because of the Lake Byllesby total maximum daily load and, potentially,
the Lake Pepin total maximum daily load. This appropriation is not available until the
commissioner of finance determines that at least an equal amount is committed to the
project from nonstate sources.

new text begin To provide the money appropriated in subdivision 1 from
the bond proceeds fund, the commissioner of finance shall sell and issue bonds of the
state in an amount up to $8,676,000 in the manner, upon the terms, and with the effect
prescribed by Minnesota Statutes, sections 16A.631 to 16A.675, and by the Minnesota
Constitution, article XI, sections 4 to 7.
