  1.1                          A bill for an act 
  1.2             relating to natural resources; requiring the 
  1.3             commissioner of natural resources to remove certain 
  1.4             obstructions in natural watercourses; proposing coding 
  1.5             for new law in Minnesota Statutes, chapter 103G. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [103G.715] [WATERCOURSE OBSTRUCTION WITHIN 
  1.8   STATE LAND.] 
  1.9      (a) The commissioner shall remove an obstruction from the 
  1.10  portion of a natural watercourse that flows through land owned 
  1.11  by the state and administered by the commissioner if the 
  1.12  obstruction has the potential to cause flooding on privately 
  1.13  owned property adjacent to the state land by: 
  1.14     (1) damming the watercourse and creating an impoundment of 
  1.15  water; or 
  1.16     (2) altering the course of the water.  
  1.17     (b) For purposes of this section, "obstruction" includes, 
  1.18  but is not limited to, an accumulation of silt, trees, logs, 
  1.19  stumps, or trash.  
  1.20     Sec. 2.  [FUNDING.] 
  1.21     The costs of the duty prescribed by section 1 shall be 
  1.22  discharged through funds appropriated by Laws 1995, chapter 220, 
  1.23  section 5.
