  1.1                          A bill for an act 
  1.2             relating to the legislature; defining which members 
  1.3             are subject to the legislators' retirement law; 
  1.4             proposing coding for new law in Minnesota Statutes, 
  1.5             chapter 3A. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [3A.15] [MEMBERS EXCLUDED FROM COVERAGE.] 
  1.8      This chapter does not apply to a person first elected to 
  1.9   the house of representatives or senate in 1994 or thereafter.  
  1.10  The service of persons first elected in 1994 or thereafter is 
  1.11  employment subject to sections 355.01 to 355.08 and under the 
  1.12  authority of those sections the governor shall enter an 
  1.13  agreement with the secretary of health and human services 
  1.14  consistent with the provisions of United States Code, title 42, 
  1.15  section 418, to extend the benefits of the federal old age, 
  1.16  survivors, and disability insurance system to those persons. 
  1.17     If a member first elected in 1994 or thereafter made 
  1.18  contributions into the legislators' retirement plan under this 
  1.19  chapter prior to the effective date of this section, the 
  1.20  director shall transfer all contributions to the appropriate 
  1.21  fund so that the member receives social security credit in the 
  1.22  same manner as any other employee of the state or a political 
  1.23  subdivision thereof.
