  1.2             relating to appropriations; expanding the use of money 
  1.3             available for feedlot improvements; amending Laws 
  1.4             2001, First Special Session chapter 2, section 2, 
  1.5             subdivision 2. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Laws 2001, First Special Session chapter 2, 
  1.8   section 2, subdivision 2, is amended to read:

  1.16  $2,348,000 the first year and 
  1.17  $2,348,000 the second year are for the 
  1.18  clean water partnership program.  Any 
  1.19  balance remaining in the first year 
  1.20  does not cancel and is available for 
  1.21  the second year of the biennium. 
  1.22  $2,341,000 the first year and 
  1.23  $2,341,000 the second year are for 
  1.24  grants for county administration of the 
  1.25  feedlot permit program.  These amounts 
  1.26  are transferred to the board of water 
  1.27  and soil resources for disbursement in 
  1.28  accordance with Minnesota Statutes, 
  1.29  section 103B.3369, in cooperation with 
  1.30  the pollution control agency.  Grants 
  1.31  must be matched with a combination of 
  1.32  local cash and/or in-kind contributions.
  1.33  Counties receiving these grants shall 
  1.34  submit an annual report to the 
  1.35  pollution control agency regarding 
  2.1   activities conducted under the grant, 
  2.2   expenditures made, and local match 
  2.3   contributions and the pollution control 
  2.4   agency shall report this information to 
  2.5   the chairs of the legislative 
  2.6   committees with oversight of feedlot 
  2.7   programs.  First priority for funding 
  2.8   shall be given to counties that have 
  2.9   requested and received delegation from 
  2.10  the pollution control agency for 
  2.11  processing of animal feedlot permit 
  2.12  applications under Minnesota Statutes, 
  2.13  section 116.07, subdivision 7.  For 
  2.14  each year of the grant, delegated 
  2.15  counties shall be eligible to receive 
  2.16  an amount of either:  (1) $50 
  2.17  multiplied by the number of feedlots 
  2.18  with greater than ten animal units as 
  2.19  determined by (i) registration data 
  2.20  under Minnesota Rules, part 7020.0350, 
  2.21  (ii) if registration data are not yet 
  2.22  complete, a level 1 feedlot inventory 
  2.23  conducted in accordance with the 
  2.24  Feedlot Inventory Guidebook published 
  2.25  by the board of water and soil 
  2.26  resources, dated June 1991, or (iii) if 
  2.27  registration or an inventory has not 
  2.28  been completed, the number of livestock 
  2.29  or poultry farms with sales greater 
  2.30  than $10,000, as reported in the 1997 
  2.31  Census of Agriculture, published by the 
  2.32  United States Bureau of Census; or (2) 
  2.33  $80 multiplied by the number of 
  2.34  feedlots with greater than ten animal 
  2.35  units as determined by a level 2 or 
  2.36  level 3 feedlot inventory conducted in 
  2.37  accordance with the Feedlot Inventory 
  2.38  Guidebook published by the board of 
  2.39  water and soil resources, dated June 
  2.40  1991.  At a minimum, delegated counties 
  2.41  are eligible to receive a grant of 
  2.42  $7,500 per year.  To receive the 
  2.43  additional funding that is based on the 
  2.44  county feedlot inventory, the inventory 
  2.45  information shall be current within the 
  2.46  most recent four-year period and the 
  2.47  county shall submit a copy of the 
  2.48  inventory to the pollution control 
  2.49  agency.  Any remaining money is for 
  2.50  distribution to all counties on a 
  2.51  competitive basis through the challenge 
  2.52  grant process for the conducting of 
  2.53  feedlot inventories, development of 
  2.54  delegated county feedlot programs, and 
  2.55  for information and education or 
  2.56  technical assistance efforts to reduce 
  2.57  feedlot-related pollution 
  2.58  hazards.  Counties may use any grant 
  2.59  money remaining available at the end of 
  2.60  each fiscal year to provide financial 
  2.61  assistance to livestock producers for 
  2.62  the improvement of feedlots to meet 
  2.63  environmental standards.  Any money 
  2.64  remaining after the first year is 
  2.65  available for the second year.  Of this 
  2.66  amount, $500,000 each year is a 
  2.67  one-time appropriation. 
  2.68  $328,000 the first year and $335,000 
  2.69  the second year are for community 
  2.70  technical assistance and education, 
  3.1   including grants and technical 
  3.2   assistance to communities for local and 
  3.3   basinwide water quality protection. 
  3.4   $204,000 the first year and $205,000 
  3.5   the second year are for individual 
  3.6   sewage treatment system (ISTS) 
  3.7   administration.  Of this amount, 
  3.8   $86,000 in each year is transferred to 
  3.9   the board of water and soil resources 
  3.10  for assistance to local units of 
  3.11  government through competitive grant 
  3.12  programs for ISTS program development. 
  3.13  $200,000 the first year and $200,000 
  3.14  the second year are for individual 
  3.15  sewage treatment system grants.  Any 
  3.16  unexpended balance in the first year 
  3.17  does not cancel, but is available in 
  3.18  the second year. 
  3.19  $13,000 the first year and $100,000 the 
  3.20  second year are from the environmental 
  3.21  fund for implementation of the Lake 
  3.22  Superior Lakewide Management Plan 
  3.23  (LaMP).  This is a one-time 
  3.24  appropriation and shall be supplemented 
  3.25  the first year by the appropriation 
  3.26  under section 14, subdivision 7, 
  3.27  paragraph (e). 
  3.28  Notwithstanding Minnesota Statutes, 
  3.29  section 16A.28, the appropriations 
  3.30  encumbered under contract on or before 
  3.31  June 30, 2003, for clean water 
  3.32  partnership, ISTS, and Minnesota River 
  3.33  grants in this subdivision are 
  3.34  available until June 30, 2005.
