  1.1                          A bill for an act 
  1.2             relating to agriculture; repealing the Minnesota 
  1.3             wetlands conservation law; amending Minnesota Statutes 
  1.4             1994, sections 103E.701, subdivision 6; and 103G.211; 
  1.5             repealing Minnesota Statutes 1994, sections 103G.221, 
  1.6             subdivision 1; 103G.222; 103G.223; 103G.2241; 
  1.7             103G.2242; 103G.225; 103G.231; 103G.235; 103G.2364; 
  1.8             103G.237; 103G.2372; 103G.2373; Minnesota Statutes 
  1.9             1995 Supplement, section 103G.2365. 
  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11     Section 1.  Minnesota Statutes 1994, section 103E.701, 
  1.12  subdivision 6, is amended to read: 
  1.13     Subd. 6.  [WETLAND RESTORATION AND MITIGATION.] Repair of a 
  1.14  drainage system may include the restoration or enhancement of 
  1.15  wetlands; wetland replacement under section 103G.222; and the 
  1.16  realignment of a drainage system to prevent drainage of a 
  1.17  wetland.  
  1.18     Sec. 2.  Minnesota Statutes 1994, section 103G.211, is 
  1.19  amended to read: 
  1.20     103G.211 [DRAINAGE OF PUBLIC WATERS GENERALLY PROHIBITED 
  1.21  WITHOUT REPLACEMENT.] 
  1.22     Except as provided in sections 103G.221 to 103G.235, Public 
  1.23  waters, except public waters wetlands, may not be drained, and a 
  1.24  permit authorizing drainage of public waters may not be issued, 
  1.25  unless the public waters to be drained are replaced by public 
  1.26  waters that will have equal or greater public value.  
  1.27     Sec. 3.  [REPEALER.] 
  2.1      Minnesota Statutes 1994, sections 103G.221, subdivision 1; 
  2.2   103G.222; 103G.223; 103G.2241; 103G.2242; 103G.225; 103G.231; 
  2.3   103G.235; 103G.2364; 103G.237; 103G.2372; 103G.2373; and 
  2.4   Minnesota Statutes 1995 Supplement, section 103G.2365, are 
  2.5   repealed.
