  1.1                          A bill for an act 
  1.2             relating to criminal justice; providing that certain 
  1.3             violent offenders consent to on-demand searches as a 
  1.4             condition of being released on probation, supervised 
  1.5             release, or parole; amending Minnesota Statutes 2002, 
  1.6             sections 244.05, by adding a subdivision; 609.135, by 
  1.7             adding a subdivision. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 2002, section 244.05, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 2a.  [RANDOM SEARCHES.] (a) This subdivision applies 
  1.12  to inmates who were convicted of and imprisoned for a violent 
  1.13  crime, as defined in section 609.1095, involving the sale, use, 
  1.14  or possession of a controlled substance or a dangerous weapon. 
  1.15     (b) When an inmate is released on supervised release or 
  1.16  parole, the inmate, as a condition of release, consents to a 
  1.17  search of the inmate's person and any motor vehicle in which the 
  1.18  inmate is found.  The search may be conducted on demand by any 
  1.19  parole or supervised release agent or peace officer.  
  1.20     [EFFECTIVE DATE.] This section is effective August 1, 2004, 
  1.21  and applies to crimes committed on or after that date. 
  1.22     Sec. 2.  Minnesota Statutes 2002, section 609.135, is 
  1.23  amended by adding a subdivision to read: 
  1.24     Subd. 9.  [RANDOM SEARCHES.] (a) This subdivision applies 
  1.25  to offenders who are convicted of a violent crime, as defined in 
  1.26  section 609.1095, involving the sale, use, or possession of a 
  2.1   controlled substance or a dangerous weapon. 
  2.2      (b) When an offender is placed on probation, the offender, 
  2.3   as a condition of being released on probation, consents to a 
  2.4   search of the offender's person and any motor vehicle in which 
  2.5   the offender is found.  The search may be conducted on demand by 
  2.6   any probation officer or peace officer. 
  2.7      [EFFECTIVE DATE.] This section is effective August 1, 2004, 
  2.8   and applies to crimes committed on or after that date.
