  1.1                          A bill for an act 
  1.2             relating to crimes; prohibiting presenting false 
  1.3             information for purposes of certain background 
  1.4             studies; prohibiting certain entities from employing 
  1.5             individuals under certain circumstances; prescribing 
  1.6             penalties; proposing coding for new law in Minnesota 
  1.7             Statutes, chapter 609. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [609.2345] [PROHIBITED WORKERS.] 
  1.10     Subdivision 1.  [PRESENTING FALSE INFORMATION FOR A 
  1.11  BACKGROUND STUDY.] A person who intentionally presents, causes 
  1.12  to be presented, or prepares with knowledge or reason to believe 
  1.13  that it will be presented, to the commissioner of human services 
  1.14  or the commissioner of health, for purposes of a background 
  1.15  study under section 245A.04, any information that contains a 
  1.16  false representation as to any material fact regarding the 
  1.17  applicant's name, address, sex, date of birth, drivers license 
  1.18  number, or criminal history is guilty of a crime and may be 
  1.19  sentenced as provided in subdivision 3. 
  1.20     Subd. 2.  [HIRING DISQUALIFIED PERSONS.] An entity that is 
  1.21  required to conduct a background check under section 245A.04 
  1.22  that employs an individual after receiving notice from the 
  1.23  commissioner of human services, health, or corrections that the 
  1.24  individual is disqualified under law from being employed and 
  1.25  must be removed, is guilty of a crime and may be sentenced as 
  1.26  provided in subdivision 3. 
  2.1      Subd. 3.  [SENTENCING.] A person or entity that violates 
  2.2   this section may be sentenced to imprisonment for not more than 
  2.3   one year or to payment of a fine of not more than $3,000 or both.
  2.4      Sec. 2.  [EFFECTIVE DATE.] 
  2.5      Section 1 is effective August 1, 2002, and applies to 
  2.6   crimes committed on or after that date.
