A bill for an act
relating to motor vehicles; defining "farm truck" as
including certain vehicles
owned by persons transporting wood products
on behalf of farmers or certain
loggers; making clarifying revisions;
amending Minnesota Statutes 2004, section
168.011,
subdivision 17.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota
Statutes 2004, section 168.011, subdivision 17, is amended to
read:
(a) "Farm truck"
means deleted text begin all single-unit trucks, truck-tractors,
tractors,
semitrailers, and trailersdeleted text end new text begin a single-unit truck, truck-tractor,
tractor, semitrailer, or

transport new text begin farm products as provided in paragraphs
(b) and
(c), forest products or related materials as provided in paragraphs (d), (e),
and (f),
or other personal property as provided in paragraph
(g).

A farm truck may be used to:

new text begin (1) transport farm products produced and finished
by the owner from farm to
market; or
new text end
new text begin (2) occasionally
transport unprocessed and raw farm products not produced by the
owner
from the place of production to the market when the transportation constitutes
the
first haul of the products.

new text begin In this paragraph,
"farm products" includes but is not limited to new text end agricultural, horticultural,
new text begin and new text end dairynew text begin productsnew text end ,
anddeleted text begin other farm products, including deleted text end livestockdeleted text begin , produced
or finished by
the owner of the truck, and any other personal property
owned by the farmer to whom
the license for the truck is issued,
from the farm to market, and to transport property and
supplies
to the farm of the owner. Trucks, truck-tractors, tractors, semitrailers,
and trailers
registered as "farm trucks" may be used by the owner
thereof to occasionally transport
unprocessed
and raw farm products, not produced by the owner of the truck, from the
place
of production to market when the transportation constitutes the first haul
of the
products, and may be used by the owner thereof, eitherdeleted text end new text begin .

new text begin (c) A farm truck may
be used to transport milk or cream en route from a farm to an
assembly
point, from a farm to a place for final manufacture, or from an assembly point
to
a place for final processing or manufacture. A farm truck so
used must be a single-unit
truck that, because of its construction,
can only be used to transport milk or cream. On
return trips, the owner may deliver butter,
cream, cheese, or other dairy supplies to patrons.new text end
new text begin (d) A farm truck may be used to transport
raw and unfinished forest products. In
this paragraph, "forest products" includes
but is not limited to logs, pulpwood, lumber,
wood chips, and railroad ties. The owner
of a farm truck so used must be a new text end farmer deleted text begin ordeleted text end new text begin , a
new text end logger
who harvests and hauls forest products only, deleted text begin to transport logs, pulpwood,
lumber,
chips, railroad ties and other raw and unfinisheddeleted text end new text begin or
a person employed by or contracting
with the farmer or logger to transport
the forest products. Transportation of the new text end forest
products new text begin must
be new text end from the place of production to an intermediate or final assembly point
or
transfer yard or railheaddeleted text begin , whichdeleted text end new text begin . The new text end transportation
may be continued by another farm
truck to a place for final processing
or manufacture located within 200 miles of the place
of production deleted text begin and
all of which isdeleted text end new text begin . The initial transportation and the continuation
are
new text end deemed to constitute the first haul of unfinished
wood productsdeleted text begin ; provided that the owner
and operator of the vehicle transportingdeleted text end new text begin .

new text begin (e) A
farm truck may be used to transport new text end planed lumber deleted text begin shall havedeleted text end new text begin if
the owner or
operator described in paragraph (d) has new text end in immediate
possession a statement deleted text begin signed by the
producer of the lumberdeleted text end designating
the governmental subdivision, section, and township
where
the lumber was produced and new text begin stating new text end that this deleted text begin haul, indicating
the date,deleted text end new text begin shipment
new text end is the first haul deleted text begin thereofdeleted text end new text begin of
the lumber. The statement must be dated and must be signed
by
the producer of the lumbernew text end .
deleted text begin The licensed vehiclesdeleted text end new text begin (f) A farm truck new text end may deleted text begin alsodeleted text end be
used deleted text begin by the owner thereofdeleted text end to
transportdeleted text begin ,deleted text end to and from
timber-harvesting areasdeleted text begin ,deleted text end equipment and appurtenances incidental
to
timber harvesting, and new text begin to transport new text end gravel and other
road-building materials for timber
haul roads.

shall also include only single-unit trucks that, because of their
construction,
cannot be used for any other purpose and are used exclusively to transport
milk
and cream en route from a farm to an assembly point or place for final manufacture,
and
for transporting milk and cream from an assembly point to a place for final
processing
or manufacture. This section shall not be construed
to mean that the owner or operator
of the truck
cannot carry on usual accommodation services for patrons on regular return
trips,
such as butter, cream, cheese, and other dairy supplies.

be used to:

from farm to market other personal property owned by the farmer to
whom
the truck is registered; or

new text begin (2) transport property or supplies to the farm of the
owner.
