  1.1                          A bill for an act
  1.2             relating to health; prohibiting human cloning; 
  1.3             providing criminal penalties; proposing coding for new 
  1.4             law in Minnesota Statutes, chapters 145; and 214. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [145.4245] [HUMAN CLONING; PROHIBITION.] 
  1.7      Subdivision 1.  [PROHIBITION.] (a) It is unlawful for any 
  1.8   person to engage in human cloning. 
  1.9      (b) It is unlawful for any person to purchase or sell an 
  1.10  ovum, zygote, embryo, or fetus for the purpose of human cloning. 
  1.11     Subd. 2.  [PENALTIES.] A person who violates subdivision 1, 
  1.12  paragraph (a), is guilty of a felony.  A person who violates 
  1.13  subdivision 1, paragraph (b), is guilty of a gross misdemeanor. 
  1.14     Subd. 3.  [DEFINITION.] For purposes of this section, 
  1.15  "human cloning" means the practice of creating or attempting to 
  1.16  create a human being by transferring the nucleus from a human 
  1.17  cell from whatever source into a human egg cell from which the 
  1.18  nucleus has been removed for the purpose of initiating a 
  1.19  pregnancy that could result in the birth of a human being.  
  1.20  Human cloning does not include: 
  1.21     (1) in vitro fertilization, the administration of 
  1.22  fertility-enhancing drugs, or other medical procedures used to 
  1.23  help a woman become or remain pregnant, as long as the pregnancy 
  1.24  is not intended to result in a child who is genetically 
  1.25  identical to another human being; or 
  2.1      (2) any activity or procedure that results, directly or 
  2.2   indirectly, in two or more natural identical twins. 
  2.3      Sec. 2.  [214.104] [HUMAN CLONING; REVOCATION OF LICENSE.] 
  2.4      Upon a finding that a regulated person has violated any of 
  2.5   the provisions of section 145.4245, a health-related licensing 
  2.6   board shall revoke the license of the regulated person.
