  1.1                          A bill for an act 
  1.2             relating to crimes; providing penalties; prohibiting 
  1.3             use and sale of electronic devices that change traffic 
  1.4             signals; amending Minnesota Statutes 2002, section 
  1.5             609.851, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2002, section 609.851, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 3.  [GROSS MISDEMEANOR.] (a) A person is guilty of a 
  1.10  gross misdemeanor if: 
  1.11     (1) the person without authorization knowingly uses, owns, 
  1.12  or possesses an electronic device designed to change a traffic 
  1.13  signal; 
  1.14     (2) the person acts outside the scope of the person's 
  1.15  authorization in using the electronic device to change a traffic 
  1.16  signal; or 
  1.17     (3) the person sells or distributes an electronic device 
  1.18  designed to change a traffic signal to a person whom the seller 
  1.19  or distributor knows or reasonably should know is not authorized 
  1.20  to use, own, or possess the device in Minnesota. 
  1.21     (b) A person is not authorized to use, own, or possess an 
  1.22  electronic device designed to change a traffic signal unless: 
  1.23     (1) the person owns or operates an authorized emergency 
  1.24  vehicle listed in section 169.01, subdivision 5; and 
  1.25     (2) the person is authorized by the state or a municipal 
  2.1   corporation or subdivision of the state to own or use the 
  2.2   electronic device. 
  2.3   The limitations of this paragraph on ownership and possession do 
  2.4   not apply to a manufacturer, dealer, or carrier who owns or 
  2.5   possesses the device solely for resale or delivery to another. 
  2.6      Sec. 2.  [EFFECTIVE DATE.] 
  2.7      Section 1 is effective August 1, 2004, and applies to 
  2.8   crimes committed on or after that date.
