A bill for an act
relating to local government; regulating location of utility easements for new
subdivisions; amending Minnesota Statutes 2014, section 462.358, by adding a
subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2014, section 462.358, is amended by adding a
subdivision to read:

new text begin Utility easements. new text end

new text begin A municipality that regulates subdivisions pursuant to
this section must require that the water and sewer easement abuts the utility and drainage
easement, provided that the two easements must not overlap. The utility and drainage
easement must be closer to the road and the water and sewer easement must be closer to
the building. The water and sewer easement must be at least ten feet wide. Water and
sewer laterals must be installed inside the water and sewer easement on the side away
from the utility and drainage easement. An ordinance provision that is inconsistent with
this subdivision is void.
