A bill for an act
relating to watershed districts; requiring watershed districts to get municipal
approval before acquiring property in the municipality; amending Minnesota
Statutes 2010, section 103D.335, subdivision 11.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2010, section 103D.335, subdivision 11, is amended to
read:
new text begin (a) new text end The managers may acquire by gift, purchase,
taking under the procedures of this chapter, or by the power of eminent domain, necessary
real and personal property. The watershed district may acquire property outside the
watershed district where necessary for a water supply system.

(b) Notwithstanding paragraph (a), a watershed district may acquire real property
within the jurisdiction of a statutory or home rule charter city or town only if the governing
body of the city or town adopts a resolution in support of the acquisition, unless the most
current plan adopted by the watershed district under section 103B.231 and approved by
the Board of Water and Soil Resources identifies and designates the real property for
acquisition by the district.
