  1.1                          A bill for an act 
  1.2             relating to retirement; Minneapolis fire department 
  1.3             relief association; making certain survivor benefit 
  1.4             options retroactive. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [MINNEAPOLIS FIRE; OPTIONAL ANNUITY EXTENSION 
  1.7   TO CERTAIN SURVIVORS.] 
  1.8      (a) Notwithstanding Laws 1997, chapter 233, article 4, 
  1.9   section 18, the surviving spouse of any service pensioner or 
  1.10  disability benefit recipient of the Minneapolis fire department 
  1.11  relief association who died between January 1, 1997, and October 
  1.12  1, 1997, is entitled to a surviving spouse benefit equal to the 
  1.13  100 percent joint and survivor annuity amount which the decedent 
  1.14  would have been eligible to select if the decedent had been 
  1.15  entitled and able to select an optional annuity form on the date 
  1.16  of death. 
  1.17     (b) The benefit under paragraph (a) is in lieu of any other 
  1.18  survivor benefit payable from the Minneapolis fire department 
  1.19  relief association. 
  1.20     (c) The benefit under this section accrues as of October 1, 
  1.21  1997, and is payable on the first day of the month next 
  1.22  following the effective date of this section.  The initial 
  1.23  benefit payment must include the increase amounts retroactive to 
  1.24  October 1, 1997. 
  1.25     Sec. 2.  [EFFECTIVE DATE.] 
  2.1      Section 1 is effective upon approval by the city council of 
  2.2   the city of Minneapolis and compliance with Minnesota Statutes, 
  2.3   section 645.021, subdivision 3.
