1.1 A bill for an act 1.2 relating to juvenile traffic offenders; providing for 1.3 adult court jurisdiction over juveniles who commit 1.4 nonfelony level traffic offenses after becoming 16 1.5 years of age; amending Minnesota Statutes 1998, 1.6 section 260.193, subdivisions 1 and 4. 1.7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.8 Section 1. Minnesota Statutes 1998, section 260.193, 1.9 subdivision 1, is amended to read: 1.10 Subdivision 1. [DEFINITIONS.] (a) For purposes of this 1.11 section, the following terms have the meanings given them. 1.12 (b) "Major traffic offense" includes any violation of a 1.13 state or local traffic law, ordinance, or regulation, or a 1.14 federal, state, or local water traffic law not included within 1.15 the provisions of clause (c). 1.16 (c) "Adult court traffic offense" means:1.17(1)a petty misdemeanor, misdemeanor, or gross misdemeanor 1.18 violation of a state or local traffic law, ordinance, or 1.19 regulation, or a petty misdemeanor, misdemeanor, or gross 1.20 misdemeanor violation of a federal, state, or local water 1.21 traffic law; or1.22(2) a violation of section 169.121, 169.129, or any other1.23misdemeanor- or gross misdemeanor-level traffic violation1.24committed as part of the same behavioral incident as a violation1.25of section 169.121 or 169.129. 1.26 Sec. 2. Minnesota Statutes 1998, section 260.193, 2.1 subdivision 4, is amended to read: 2.2 Subd. 4. [ORIGINAL JURISDICTION; JUVENILE COURT; ADULT 2.3 COURT.] (a) The juvenile courtshall havehas original 2.4 jurisdiction over: 2.5 (1) all juvenilesage 15 and underalleged to have 2.6 committed any traffic offense before becoming 16 years of age; 2.7 and 2.8 (2)16- and 17-year-oldsall juveniles alleged to have 2.9 committedanya major traffic offense, except that the adult2.10court has original jurisdiction over:2.11(i) petty traffic misdemeanors not a part of the same2.12behavioral incident of a misdemeanor being handled in juvenile2.13court; and2.14(ii) violations of sections 169.121 (drivers under the2.15influence of alcohol or controlled substance) and 169.1292.16(aggravated driving while intoxicated), and any other2.17misdemeanor or gross misdemeanor level traffic violations2.18committed as part of the same behavioral incident of a violation2.19of section 169.121 or 169.129after becoming 16 years of age. 2.20 (b) The adult court has original jurisdiction over all 2.21 juveniles alleged to have committed an adult court traffic 2.22 offense after becoming 16 years old. 2.23 Sec. 3. [EFFECTIVE DATE.] 2.24 Sections 1 and 2 are effective August 1, 1999, and apply to 2.25 offenses committed on or after that date.
