  1.1                          A bill for an act 
  1.2             relating to education; authorizing performance 
  1.3             contracts for school district superintendents; 
  1.4             permitting increased salaries for superintendents; 
  1.5             amending Minnesota Statutes 1996, section 123.34, by 
  1.6             adding a subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1996, section 123.34, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 9b.  [SUPERINTENDENT PERFORMANCE CONTRACTS.] The 
  1.11  board of a district may enter into an employment contract with a 
  1.12  superintendent containing performance results the superintendent 
  1.13  must achieve.  The performance results may include student 
  1.14  achievement, curriculum improvement, quality of instruction, 
  1.15  student attendance, family involvement, community involvement, 
  1.16  school district management, or any other performance result 
  1.17  desired by the board. 
  1.18     Notwithstanding section 43A.17, subdivision 9, if the 
  1.19  superintendent achieves the required performance results, the 
  1.20  board may fix the superintendent's compensation exceeding 95 
  1.21  percent of the salary of the governor as set under section 
  1.22  15A.082.  The board must establish a review and evaluation 
  1.23  procedure to measure achievement of the performance results.
