  1.1                          A bill for an act 
  1.2             relating to game and fish; modifying possession 
  1.3             requirements for pheasant stamps and migratory 
  1.4             waterfowl stamps; amending Minnesota Statutes 2002, 
  1.5             sections 97A.405, subdivision 2; 97A.473, subdivisions 
  1.6             1, 2, 3, 5; 97A.474; 97A.475, subdivision 5; 97B.715, 
  1.7             subdivision 1; 97B.801; repealing Minnesota Statutes 
  1.8             2002, section 97A.411, subdivision 2. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2002, section 97A.405, 
  1.11  subdivision 2, is amended to read: 
  1.12     Subd. 2.  [PERSONAL POSSESSION.] (a) A person acting under 
  1.13  a license or traveling from an area where a licensed activity 
  1.14  was performed must have in personal possession either:  (1) the 
  1.15  proper license, if the license has been issued to and received 
  1.16  by the person; or (2) the proper license identification number 
  1.17  or stamp validation, if the license has been sold to the person 
  1.18  by electronic means but the actual license has not been issued 
  1.19  and received. 
  1.20     (b) If possession of a license or a license identification 
  1.21  number is required, a person must exhibit, as requested by a 
  1.22  conservation officer or peace officer, either:  (1) the proper 
  1.23  license if the license has been issued to and received by the 
  1.24  person; or (2) the proper license identification number or stamp 
  1.25  validation and a valid state driver's license, state 
  1.26  identification card, or other form of identification provided by 
  1.27  the commissioner, if the license has been sold to the person by 
  2.1   electronic means but the actual license has not been issued and 
  2.2   received.  
  2.3      (c) If the actual license has been issued and received, a 
  2.4   receipt for license fees, a copy of a license, or evidence 
  2.5   showing the issuance of a license, including the license 
  2.6   identification number or stamp validation, does not entitle a 
  2.7   licensee to exercise the rights or privileges conferred by a 
  2.8   license.  
  2.9      (d) A license or stamp issued electronically and not 
  2.10  immediately provided to the licensee shall be mailed to the 
  2.11  licensee within 30 days of purchase of the license or stamp 
  2.12  validation, except for a pictorial turkey stamp or a pictorial 
  2.13  trout and salmon stamp.  A pictorial turkey stamp or a pictorial 
  2.14  trout and salmon stamp shall be mailed to the licensee after 
  2.15  purchase of a license or stamp validation only if the licensee 
  2.16  pays an additional $2 fee. 
  2.17     Sec. 2.  Minnesota Statutes 2002, section 97A.473, 
  2.18  subdivision 1, is amended to read: 
  2.19     Subdivision 1.  [RESIDENT LIFETIME LICENSES AUTHORIZED.] 
  2.20  (a) The commissioner may issue a lifetime angling license, a 
  2.21  lifetime small game hunting license, a lifetime firearm or 
  2.22  archery deer hunting license, or a lifetime sporting license to 
  2.23  a person who is a resident of the state for at least one year or 
  2.24  who is under age 21 and the child of a person who is a resident 
  2.25  of the state for at least one year.  The license fees paid for a 
  2.26  lifetime license are nonrefundable. 
  2.27     (b) The commissioner may require the holder of a lifetime 
  2.28  license issued under this section to notify the department each 
  2.29  year that the license is used, by: 
  2.30     (1) telephone or Internet notification, as specified by the 
  2.31  commissioner; 
  2.32     (2) the purchase of stamps stamp validations for the 
  2.33  license; or 
  2.34     (3) registration and tag issuance, in the case of the 
  2.35  resident lifetime deer license. 
  2.36     Sec. 3.  Minnesota Statutes 2002, section 97A.473, 
  3.1   subdivision 2, is amended to read: 
  3.2      Subd. 2.  [LIFETIME ANGLING LICENSE; FEE.] (a) A resident 
  3.3   lifetime angling license authorizes a person to take fish by 
  3.4   angling in the state.  The license authorizes those activities 
  3.5   authorized by the annual resident angling license.  The license 
  3.6   does not include a trout and salmon stamp validation or 
  3.7   other stamps stamp validations required by law.  
  3.8      (b) The fees for a resident lifetime angling license are: 
  3.9      (1) age 3 and under, $227; 
  3.10     (2) age 4 to age 15, $300; 
  3.11     (3) age 16 to age 50, $383; and 
  3.12     (4) age 51 and over, $203. 
  3.13     Sec. 4.  Minnesota Statutes 2002, section 97A.473, 
  3.14  subdivision 3, is amended to read: 
  3.15     Subd. 3.  [LIFETIME SMALL GAME HUNTING LICENSE; FEE.] (a) A 
  3.16  resident lifetime small game hunting license authorizes a person 
  3.17  to hunt small game in the state.  The license authorizes those 
  3.18  hunting activities authorized by the annual resident small game 
  3.19  hunting license.  The license does not include a turkey stamp 
  3.20  validation or any other hunting stamps required by law, a 
  3.21  pheasant stamp validation, or a migratory waterfowl stamp 
  3.22  validation. 
  3.23     (b) The fees for a resident lifetime small game hunting 
  3.24  license are: 
  3.25     (1) age 3 and under, $217; 
  3.26     (2) age 4 to age 15, $290; 
  3.27     (3) age 16 to age 50, $363; and 
  3.28     (4) age 51 and over, $213. 
  3.29     Sec. 5.  Minnesota Statutes 2002, section 97A.473, 
  3.30  subdivision 5, is amended to read: 
  3.31     Subd. 5.  [LIFETIME SPORTING LICENSE; FEE.] (a) A resident 
  3.32  lifetime sporting license authorizes a person to take fish by 
  3.33  angling and hunt small game in the state.  The license 
  3.34  authorizes those activities authorized by the annual resident 
  3.35  angling and resident small game hunting licenses.  The license 
  3.36  does not include a trout and salmon stamp validation, a turkey 
  4.1   stamp validation, or any other hunting stamps required by law a 
  4.2   pheasant stamp validation, or a migratory waterfowl stamp 
  4.3   validation.  
  4.4      (b) The fees for a resident lifetime sporting license are: 
  4.5      (1) age 3 and under, $357; 
  4.6      (2) age 4 to age 15, $480; 
  4.7      (3) age 16 to age 50, $613; and 
  4.8      (4) age 51 and over, $413. 
  4.9      Sec. 6.  Minnesota Statutes 2002, section 97A.474, is 
  4.10  amended to read: 
  4.11     97A.474 [NONRESIDENT LIFETIME LICENSES.] 
  4.12     Subdivision 1.  [NONRESIDENT LIFETIME LICENSES AUTHORIZED.] 
  4.13  (a) The commissioner may issue a lifetime angling license or a 
  4.14  lifetime small game hunting license to a nonresident.  The 
  4.15  license fees paid for a lifetime license are nonrefundable. 
  4.16     (b) The commissioner may require the holder of a lifetime 
  4.17  license issued under this section to notify the department each 
  4.18  year that the license is used, by: 
  4.19     (1) telephone or Internet notification, as specified by the 
  4.20  commissioner; or 
  4.21     (2) the purchase of stamps stamp validations for the 
  4.22  license. 
  4.23     Subd. 2.  [NONRESIDENT LIFETIME ANGLING LICENSE; FEE.] (a) 
  4.24  A nonresident lifetime angling license authorizes a person to 
  4.25  take fish by angling in the state.  The license authorizes those 
  4.26  activities authorized by the annual nonresident angling 
  4.27  license.  The license does not include a trout and salmon stamp 
  4.28  validation or other stamps stamp validations required by law. 
  4.29     (b) The fees for a nonresident lifetime angling license are:
  4.30     (1) age 3 and under, $447; 
  4.31     (2) age 4 to age 15, $600; 
  4.32     (3) age 16 to age 50, $773; and 
  4.33     (4) age 51 and over, $513. 
  4.34     Subd. 3.  [NONRESIDENT LIFETIME SMALL GAME HUNTING LICENSE; 
  4.35  FEE.] (a) A nonresident lifetime small game hunting license 
  4.36  authorizes a person to hunt small game in the state.  The 
  5.1   license authorizes those hunting activities authorized by the 
  5.2   annual nonresident small game hunting license.  The license does 
  5.3   not include a turkey stamp validation or any other hunting 
  5.4   stamps required by law, a pheasant stamp validation, or a 
  5.5   migratory waterfowl stamp validation.  
  5.6      (b) The fees for a nonresident lifetime small game hunting 
  5.7   license are: 
  5.8      (1) age 3 and under, $947; 
  5.9      (2) age 4 to age 15, $1,280; 
  5.10     (3) age 16 to age 50, $1,633; and 
  5.11     (4) age 51 and over, $1,083. 
  5.12     Sec. 7.  Minnesota Statutes 2002, section 97A.475, 
  5.13  subdivision 5, is amended to read: 
  5.14     Subd. 5.  [HUNTING STAMPS STAMP VALIDATIONS.] Fees for the 
  5.15  following stamps and stamp validations are: 
  5.16     (1) migratory waterfowl stamp validation, $5; 
  5.17     (2) pheasant stamp validation, $5; and 
  5.18     (3) turkey stamp validation, $5.  
  5.19     Sec. 8.  Minnesota Statutes 2002, section 97B.715, 
  5.20  subdivision 1, is amended to read: 
  5.21     Subdivision 1.  [STAMP VALIDATION REQUIRED.] (a) Except as 
  5.22  provided in paragraph (b) or section 97A.405, subdivision 2, a 
  5.23  person required to possess a small game license may not hunt 
  5.24  pheasants without:  
  5.25     (1) a pheasant stamp in possession; and 
  5.26     (2) a pheasant stamp validation on the small game license 
  5.27  when issued electronically.  
  5.28     (b) The following persons are exempt from this subdivision: 
  5.29     (1) residents under age 18 or over age 65; 
  5.30     (2) persons hunting on licensed commercial shooting 
  5.31  preserves; and 
  5.32     (3) resident disabled veterans with a license issued under 
  5.33  section 97A.441, subdivision 6a. 
  5.34     Sec. 9.  Minnesota Statutes 2002, section 97B.801, is 
  5.35  amended to read: 
  5.36     97B.801 [MINNESOTA MIGRATORY WATERFOWL STAMP VALIDATION 
  6.1   REQUIRED.] 
  6.2      (a) Except as provided in this section or section 97A.405, 
  6.3   subdivision 2, a person required to possess a small game license 
  6.4   may not take migratory waterfowl without: 
  6.5      (1) a Minnesota migratory waterfowl stamp in possession; 
  6.6   and 
  6.7      (2) a migratory waterfowl stamp validation on the small 
  6.8   game license when issued electronically.  
  6.9      (b) Residents under age 18 or over age 65; resident 
  6.10  disabled veterans with a license issued under section 97A.441, 
  6.11  subdivision 6a; and persons hunting on their own property are 
  6.12  not required to possess have a stamp or a license validation 
  6.13  under this section.  
  6.14     Sec. 10.  [REPEALER.] 
  6.15     Minnesota Statutes 2002, section 97A.411, subdivision 2, is 
  6.16  repealed.
