  1.1                          A bill for an act 
  1.2             relating to employment; modifying the definition of 
  1.3             employment and training service provider for purposes 
  1.4             of the Minnesota Family Investment Program; amending 
  1.5             Minnesota Statutes 1997 Supplement, section 256J.49, 
  1.6             subdivision 4. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1997 Supplement, section 
  1.9   256J.49, subdivision 4, is amended to read: 
  1.10     Subd. 4.  [EMPLOYMENT AND TRAINING SERVICE PROVIDER.] 
  1.11  "Employment and training service provider" means: 
  1.12     (1) a public, private, or nonprofit employment and training 
  1.13  agency certified by the commissioner of economic security under 
  1.14  sections 268.0122, subdivision 3, and 268.871, subdivision 1, or 
  1.15  is approved under section 256J.51 and is included in the county 
  1.16  plan submitted under section 256J.50, subdivision 7; or 
  1.17     (2) a public, private, or nonprofit agency that is not 
  1.18  certified by the commissioner under clause (1), but with which a 
  1.19  county has contracted to provide employment and training 
  1.20  services and which is included in the county's plan submitted 
  1.21  under section 256J.50, subdivision 7; or 
  1.22     (3) a county agency, if the county is certified under 
  1.23  clause (1) has opted to provide employment and training services 
  1.24  and the county has indicated that fact in the plan submitted 
  1.25  under section 256J.50, subdivision 7. 
  1.26     Notwithstanding section 268.871, an employment and training 
  2.1   services provider meeting this definition may deliver employment 
  2.2   and training services under this chapter.  
  2.3      Sec. 2.  [EFFECTIVE DATE.] 
  2.4      Section 1 is effective the day following final enactment.
