  1.1                          A bill for an act
  1.2             relating to education; authorizing a school district 
  1.3             to establish parking fees contingent upon school bus 
  1.4             ridership; amending Minnesota Statutes 1996, section 
  1.5             123.39, subdivision 1, and by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 123.39, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  The board may provide for the 
  1.10  transportation of pupils to and from school and for any other 
  1.11  purpose.  The board may also provide for the transportation of 
  1.12  pupils to schools in other districts for grades and departments 
  1.13  not maintained in the district, including high school, at the 
  1.14  expense of the district, when funds are available therefor and 
  1.15  if agreeable to the district to which it is proposed to 
  1.16  transport the pupils, for the whole or a part of the school 
  1.17  year, as it may deem advisable, and subject to its rules.  In 
  1.18  any school district, the board shall arrange for the attendance 
  1.19  of all pupils living two miles or more from the school, except 
  1.20  pupils whose transportation privileges have been revoked under 
  1.21  section 123.805, subdivision 1, clause (6), or 123.7991, 
  1.22  paragraph (b), or whose privileges have been voluntarily 
  1.23  surrendered under subdivision 1a, through suitable provision for 
  1.24  transportation or through the boarding and rooming of the pupils 
  1.25  who may be more economically and conveniently provided for by 
  2.1   that means.  The board shall provide transportation to and from 
  2.2   the home of a child with a disability not yet enrolled in 
  2.3   kindergarten when special instruction and services under 
  2.4   sections 120.17 and 120.1701 are provided in a location other 
  2.5   than in the child's home.  When transportation is provided, 
  2.6   scheduling of routes, establishment of the location of bus 
  2.7   stops, manner and method of transportation, control and 
  2.8   discipline of school children and any other matter relating 
  2.9   thereto shall be within the sole discretion, control, and 
  2.10  management of the school board.  The district may provide for 
  2.11  the transportation of pupils or expend a reasonable amount for 
  2.12  room and board of pupils whose attendance at school can more 
  2.13  economically and conveniently be provided for by that means or 
  2.14  who attend school in a building rented or leased by a district 
  2.15  within the confines of an adjacent district. 
  2.16     Sec. 2.  Minnesota Statutes 1996, section 123.39, is 
  2.17  amended by adding a subdivision to read: 
  2.18     Subd. 1a.  [VOLUNTARY SURRENDER OF TRANSPORTATION 
  2.19  PRIVILEGES.] The parent or guardian of a secondary student may 
  2.20  voluntarily surrender the secondary student's to and from school 
  2.21  transportation privileges granted under subdivision 1, in 
  2.22  exchange for the privilege of obtaining school parking at a 
  2.23  reduced price.  The school district shall inform each secondary 
  2.24  student who has voluntarily surrendered transportation 
  2.25  privileges of the location of the nearest school bus stop and 
  2.26  establish a policy allowing the student to ride the bus on an 
  2.27  occasional basis.  The district must also establish a process to 
  2.28  allow a student to regain transportation privileges if the 
  2.29  student's circumstances change during the school year. 
  2.30     Sec. 3.  [EFFECTIVE DATE.] 
  2.31     Sections 1 and 2 are effective July 1, 1998.
