  1.1                          A bill for an act
  1.2             relating to human services; establishing an advisory 
  1.3             council on services to persons with mental retardation 
  1.4             and related developmental disabilities; providing 
  1.5             principles for new purchasing and delivery models; 
  1.6             proposing coding for new law in Minnesota Statutes, 
  1.7             chapter 252. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [252.53] [GENERAL PRINCIPLES.] 
  1.10     In developing and implementing new purchasing and service 
  1.11  delivery models for Minnesotans with mental retardation and 
  1.12  related developmental disabilities, the commissioner and any 
  1.13  advisory bodies established by the commissioner shall evaluate 
  1.14  existing and alternative models according to the extent that 
  1.15  they conform to the following principles:  maximum informed 
  1.16  consumer control of purchasing decisions, the utilization of 
  1.17  outcome-based data, regulatory reform, and competition based on 
  1.18  quality and cost. 
  1.19     Sec. 2.  [252.54] [ADVISORY COUNCIL ON SERVICES TO PERSONS 
  1.20  WITH MENTAL RETARDATION AND RELATED DEVELOPMENTAL DISABILITIES.] 
  1.21     Subdivision 1.  [ESTABLISHMENT.] The commissioner of human 
  1.22  services shall, by June 1, 1996, convene an advisory council 
  1.23  representative of key stakeholders in services to Minnesotans 
  1.24  with mental retardation and related developmental disabilities.  
  1.25  The advisory council shall, by January 15, 1997, present a 
  1.26  report to the commissioner and the chairs of the appropriate 
  2.1   standing committees of the legislature containing 
  2.2   recommendations for the purchasing and delivery of services to 
  2.3   Minnesotans with mental retardation and related developmental 
  2.4   disabilities.  These recommendations must conform to the 
  2.5   principles established in section 252.53. 
  2.6      Subd. 2.  [REQUIREMENTS FOR REPORT.] The advisory council's 
  2.7   report shall develop purchasing and service delivery models that 
  2.8   are driven by consumer control and based on outcomes and cost 
  2.9   effectiveness. 
  2.10     Subd. 3.  [MEMBERSHIP.] The advisory council shall consist 
  2.11  of the following 21 members: 
  2.12     (1) two members appointed by the Minnesota association for 
  2.13  retarded citizens; 
  2.14     (2) one member appointed by the Disability Law Center; 
  2.15     (3) two residential providers appointed by the association 
  2.16  of residential resources in Minnesota; 
  2.17     (4) one day training and habilitation provider appointed by 
  2.18  the Minnesota developmental achievement center association; 
  2.19     (5) one day training and habilitation provider appointed by 
  2.20  the Minnesota habilitation coalition; 
  2.21     (6) one family member of a Minnesotan with mental 
  2.22  retardation or related developmental disabilities appointed by 
  2.23  the commissioner; 
  2.24     (7) one self-advocate appointed by advocating change 
  2.25  together; 
  2.26     (8) two members appointed by the association of Minnesota 
  2.27  counties; 
  2.28     (9) two department of human services staff specializing in 
  2.29  developmental disabilities appointed by the commissioner; 
  2.30     (10) one specialist in mental retardation and related 
  2.31  developmental disabilities appointed by the Minnesota school 
  2.32  superintendents association; 
  2.33     (11) two members appointed by the American federation of 
  2.34  state, county, and municipal employees who provide services for 
  2.35  persons with developmental disabilities; 
  2.36     (12) one member appointed by the center of community living 
  3.1   and institute on community integration; 
  3.2      (13) one direct services employee employed by private 
  3.3   facilities providing services to Minnesotans with mental 
  3.4   retardation and related developmental disabilities appointed by 
  3.5   the commissioner; 
  3.6      (14) one member appointed by the united steelworkers of 
  3.7   America district council who provides services for persons with 
  3.8   developmental disabilities; 
  3.9      (15) the ombudsman for mental health and mental 
  3.10  retardation, or the ombudsman's designee; and 
  3.11     (16) one member appointed by care providers of Minnesota. 
  3.12     Subd. 4.  [GOVERNANCE.] The chair of the advisory council 
  3.13  shall be a member of the council elected by the members.  The 
  3.14  council expires June 30, 1997.
