  1.1                          A bill for an act 
  1.2             relating to crime prevention; increasing the criminal 
  1.3             penalties for predatory offenders who fail to comply 
  1.4             with registration requirements; requiring posting of 
  1.5             certain information regarding level III sex offenders 
  1.6             on the Internet; amending Minnesota Statutes 1998, 
  1.7             sections 243.166, subdivision 5; and 244.052, by 
  1.8             adding a subdivision. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1998, section 243.166, 
  1.11  subdivision 5, is amended to read: 
  1.12     Subd. 5.  [CRIMINAL PENALTY.] A person required to register 
  1.13  under this section who knowingly violates any of its provisions 
  1.14  or intentionally provides false information to a corrections 
  1.15  agent, law enforcement authority, or the bureau of criminal 
  1.16  apprehension is guilty of a gross misdemeanor felony and may be 
  1.17  sentenced to imprisonment for not more than five years or to 
  1.18  payment of a fine of not more than $10,000, or both.  A person 
  1.19  convicted of or adjudicated delinquent for violating who 
  1.20  violates this section and who previously has been convicted 
  1.21  under or adjudicated delinquent for violating this section is 
  1.22  guilty of a felony and may be sentenced to imprisonment for not 
  1.23  more than ten years or to payment of a fine of not more than 
  1.24  $20,000, or both.  
  1.25     Sec. 2.  Minnesota Statutes 1998, section 244.052, is 
  1.26  amended by adding a subdivision to read: 
  1.27     Subd. 4b.  [LEVEL III OFFENDERS; MANDATORY POSTING OF 
  2.1   INFORMATION ON INTERNET.] The commissioner of corrections shall 
  2.2   create and maintain an Internet Web site and post on the site 
  2.3   the following information about offenders assigned to risk level 
  2.4   III:  a recent photograph of the offender, the address of where 
  2.5   the offender resides or intends to reside upon release, a 
  2.6   summary of the offender's criminal conviction history, and a 
  2.7   short narrative addressing the offender's potential 
  2.8   dangerousness.  This information must be updated in a timely 
  2.9   manner to account for changes in the offender's address and 
  2.10  maintained for the period of time that the offender remains 
  2.11  classified as a level III offender and is required to register 
  2.12  under section 243.166. 
  2.13     Sec. 3.  [EFFECTIVE DATES.] 
  2.14     Section 1 is effective August 1, 2000, and applies to 
  2.15  crimes committed on or after that date.  Section 2 is effective 
  2.16  the day following final enactment and applies to all offenders 
  2.17  classified at risk level III under Minnesota Statutes, section 
  2.18  244.052, on or after that date.
