  1.1                          A bill for an act 
  1.2             relating to retirement; general state employees 
  1.3             retirement plan of the Minnesota state retirement 
  1.4             plan; authorizing a late application for disability 
  1.5             benefits from certain former employees. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [MSRS-GENERAL; LATE DISABILITY BENEFIT 
  1.8   APPLICATION AUTHORIZED.] 
  1.9      (a) Notwithstanding any provision of Minnesota Statutes, 
  1.10  section 352.113, subdivision 4, to the contrary, a person 
  1.11  described in paragraph (b) is authorized to apply for a 
  1.12  disability benefit from the general state employees retirement 
  1.13  plan of the Minnesota state retirement system under Minnesota 
  1.14  Statutes, section 352.113. 
  1.15     (b) An eligible person is a person who: 
  1.16     (1) was born on October 3, 1952; 
  1.17     (2) was employed by the department of economic security 
  1.18  from August 1978 to December 1994; 
  1.19     (3) is disabled within the meaning of Minnesota Statutes, 
  1.20  section 352.01, subdivision 17; 
  1.21     (4) began receiving social security disability insurance 
  1.22  benefits in January 1995; and 
  1.23     (5) began part-time employment and continues in that 
  1.24  employment by the Minnesota state council on disability in 
  1.25  January 1998. 
  2.1      (c) The eligible person under paragraph (b) must provide, 
  2.2   in conjunction with the disability application, any relevant 
  2.3   evidence that the executive director of the Minnesota state 
  2.4   retirement system requires about the existence of a total and 
  2.5   permanent disability as defined in Minnesota Statutes, section 
  2.6   352.01, subdivision 17, and about the date on which the 
  2.7   disability occurred and its relationship to the termination of 
  2.8   active service in December 1994. 
  2.9      (d) If the eligible person files a disability benefit 
  2.10  application and if the eligible person provides sufficient 
  2.11  evidence of disability and the occurrence of the disability 
  2.12  under paragraph (c), the disability benefit becomes payable for 
  2.13  the first month next following the application and applicable 
  2.14  evidence.  The disability benefit must be calculated under the 
  2.15  laws in effect at the time that the eligible person terminated 
  2.16  active service in December 1994.  The disability benefit must 
  2.17  include any applicable deferred annuities augmentation under 
  2.18  Minnesota Statutes, section 352.72, subdivision 2. 
  2.19     (e) Nothing in this section may be deemed to exempt the 
  2.20  eligible person from the partial reemployment of a disabilitant 
  2.21  provision, Minnesota Statutes, section 352.113, subdivision 7. 
  2.22     Sec. 2.  [EFFECTIVE DATE.] 
  2.23     (a) Section 1 is effective the day following final 
  2.24  enactment. 
  2.25     (b) Section 1 expires, if not utilized, on December 31, 
  2.26  2000.
