  1.1                          A bill for an act 
  1.2             relating to natural resources; providing for the 
  1.3             designation of personal watercraft water trails; 
  1.4             reducing the personal watercraft surcharge; amending 
  1.5             Minnesota Statutes 1998, section 86B.415, subdivision 
  1.6             7a; proposing coding for new law in Minnesota 
  1.7             Statutes, chapter 85. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [85.0157] [PERSONAL WATERCRAFT WATER TRAILS.] 
  1.10     Subdivision 1.  [CREATION.] The commissioner may designate 
  1.11  water trails primarily developed for personal watercraft using 
  1.12  lakes and rivers and existing public lands for designated rest 
  1.13  areas. 
  1.14     Subd. 2.  [COMMISSIONER'S DUTIES.] The commissioner of 
  1.15  natural resources must coordinate the creation of the water 
  1.16  trails by placing signs for rest areas along lakes and rivers on 
  1.17  the trail and working with other public agencies and private 
  1.18  resorts owning land along the areas to do the same.  At the 
  1.19  earliest opportunity, the commissioner shall make available 
  1.20  water trail maps depicting the designated rest areas for the 
  1.21  touring public. 
  1.22     Subd. 3.  [GIFTS; DONATIONS.] The commissioner of natural 
  1.23  resources is authorized to accept donations of land, or 
  1.24  easements in land, for rest areas along the personal watercraft 
  1.25  water trails and may seek and accept money for this purpose from 
  1.26  other public and private sources. 
  2.1      Sec. 2.  Minnesota Statutes 1998, section 86B.415, 
  2.2   subdivision 7a, is amended to read: 
  2.3      Subd. 7a.  [PERSONAL WATERCRAFT SURCHARGE.] A $50 $30 
  2.4   surcharge is placed on each personal watercraft licensed under 
  2.5   subdivisions 1 to 5 for to be divided equally between 
  2.6   enforcement of personal watercraft laws and for, grants to 
  2.7   groups that provide approved personal watercraft safety 
  2.8   education, and development of water trails for personal 
  2.9   watercraft under section 85.0157.  The surcharge must be 
  2.10  deposited in the state treasury and credited to the water 
  2.11  recreation account in the natural resources fund.  Any grants to 
  2.12  counties from revenue collected under this subdivision must be 
  2.13  proportional to the use of personal watercraft in each county.  
  2.14  Grants made under this subdivision are subject to the applicable 
  2.15  administrative, reporting, and auditing requirements in sections 
  2.16  86B.701 and 86B.705. 
  2.17     Sec. 3.  [PILOT PERSONAL WATERCRAFT WATER TRAIL; REPORT.] 
  2.18     The commissioner shall plan and designate one pilot 
  2.19  personal watercraft water trail under Minnesota Statutes, 
  2.20  section 85.0157, for use during the 1999 boating season.  The 
  2.21  commissioner shall meet with stakeholder groups for advice on 
  2.22  planning the pilot project.  By January 15, 2000, the 
  2.23  commissioner shall report to the legislative committees with 
  2.24  jurisdiction over natural resources policy and finance on the 
  2.25  pilot designation and to make recommendations on providing 
  2.26  additional opportunities for personal watercraft water trails. 
  2.27     Sec. 4.  [EFFECTIVE DATE.] 
  2.28     Sections 1 to 3 are effective the day following final 
  2.29  enactment.
