  1.1                          A bill for an act
  1.2             relating to state government; modifying 
  1.3             classifications for certain positions in the higher 
  1.4             education system. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [UNCLASSIFIED POSITIONS.] 
  1.7      Employees in positions unclassified under Minnesota 
  1.8   Statutes, section 43A.08, subdivision 1, clause (9), in the 
  1.9   professional bargaining unit in technical colleges, or current 
  1.10  or future colocated technical college and community colleges at 
  1.11  the Minnesota state colleges and universities, have the same 
  1.12  rights as classified employees relating to seniority, lay-off, 
  1.13  and recall. 
  1.14     Sec. 2.  [BARGAINING.] 
  1.15     The exclusive representative for the professional 
  1.16  bargaining unit and Minnesota state colleges and universities 
  1.17  shall begin negotiations no later than July 1, 1996, to reach 
  1.18  agreement regarding the remaining unclassified community college 
  1.19  employees in the professional bargaining unit as to seniority, 
  1.20  lay-off, and recall provisions.  The parties shall also begin 
  1.21  negotiations no later than July 1, 1996, regarding the right to 
  1.22  just cause protection for employees in the customized trainer 
  1.23  class. 
  1.24     Sec. 3.  [EXCEPTION.] 
  1.25     Section 1 does not apply to technical college employees in 
  2.1   the customized trainer class. 
  2.2      Sec. 4.  [DURATION.] 
  2.3      Section 1 is effective until a memorandum of understanding 
  2.4   is agreed to by the exclusive representative of the professional 
  2.5   bargaining unit and Minnesota state colleges and universities, 
  2.6   or until a successor agreement is negotiated by the parties. 
  2.7      Sec. 5.  [EFFECTIVE DATE.] 
  2.8      Sections 1 to 4 are effective the day following final 
  2.9   enactment.
