A bill for an act
relating to natural resources; requiring all vessels engaged in port operations in
this state to obtain a permit related to ballast water treatment and discharge;
amending Minnesota Statutes 2006, section 84D.01, by adding subdivisions;
proposing coding for new law in Minnesota Statutes, chapter 84D.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 84D.01, is amended by adding a
subdivision to read:

new text begin "Ballast water" means any water and associated solids,
sediment, suspended matter, and substances taken on board a vessel to control or maintain
trim, draught, stability, or stresses on the vessel, without regard to the manner in which it
is carried.

Sec. 2.

Minnesota Statutes 2006, section 84D.01, is amended by adding a subdivision
to read:

new text begin "Oceangoing vessel" means a vessel that operates
on the Great Lakes after operating in waters outside of the Great Lakes.

Sec. 3.

new text begin [84D.15] PERMITS REQUIRED FOR GREAT LAKES VESSELS.

new text begin Beginning January 1, 2008, all oceangoing vessels engaging in port operations in
this state must obtain a permit from the commissioner. The commissioner shall issue a
permit for an oceangoing vessel only if the applicant demonstrates that the vessel will not
discharge aquatic invasive species or, if the vessel discharges ballast water or other waste
or waste effluent, that the vessel operator will use environmentally sound technology
and methods, as determined by the commissioner, to prevent the discharge of aquatic
invasive species. The commissioner shall cooperate to the fullest extent practical with
other Great Lakes basin states, the Canadian Great Lakes provinces, the Great Lakes Panel
on Aquatic Nuisance Species, the Great Lakes Fishery Commission, the International
Joint Commission, and the Great Lakes Commission to ensure development of standards
for the control of aquatic invasive species that are broadly protective of the waters of the
state and other natural resources.
