  1.1                          A bill for an act 
  1.2             relating to state government; creating the Department 
  1.3             of Game and Fish; transferring certain 
  1.4             responsibilities of the commissioner of natural 
  1.5             resources to the commissioner of game and fish; 
  1.6             amending Minnesota Statutes 2003 Supplement, sections 
  1.7             15.01; 15.06, subdivision 1; proposing coding for new 
  1.8             law in Minnesota Statutes, chapter 97A. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2003 Supplement, section 
  1.11  15.01, is amended to read: 
  1.12     15.01 [DEPARTMENTS OF THE STATE.] 
  1.13     The following agencies are designated as the departments of 
  1.14  the state government:  the Department of Administration; the 
  1.15  Department of Agriculture; the Department of Commerce; the 
  1.16  Department of Corrections; the Department of Education; the 
  1.17  Department of Economic Security; the Department of Employment 
  1.18  and Economic Development; the Department of Finance; the 
  1.19  Department of Game and Fish; the Department of Health; the 
  1.20  Department of Human Rights; the Department of Labor and 
  1.21  Industry; the Department of Military Affairs; the Department of 
  1.22  Natural Resources; the Department of Employee Relations; the 
  1.23  Department of Public Safety; the Department of Human Services; 
  1.24  the Department of Revenue; the Department of Transportation; the 
  1.25  Department of Veterans Affairs; and their successor departments. 
  1.26     Sec. 2.  Minnesota Statutes 2003 Supplement, section 15.06, 
  1.27  subdivision 1, is amended to read: 
  2.1      Subdivision 1.  [APPLICABILITY.] This section applies to 
  2.2   the following departments or agencies:  the Departments of 
  2.3   Administration, Agriculture, Commerce, Corrections, Economic 
  2.4   Security, Education, Employee Relations, Employment and Economic 
  2.5   Development, Finance, Game and Fish, Health, Human Rights, Labor 
  2.6   and Industry, Natural Resources, Public Safety, Human Services, 
  2.7   Revenue, Transportation, and Veterans Affairs; the Housing 
  2.8   Finance and Pollution Control Agencies; the Office of 
  2.9   Commissioner of Iron Range Resources and Rehabilitation; the 
  2.10  Bureau of Mediation Services; and their successor departments 
  2.11  and agencies.  The heads of the foregoing departments or 
  2.12  agencies are "commissioners." 
  2.13     Sec. 3.  [97A.02] [DEPARTMENT OF GAME AND FISH; 
  2.14  COMMISSIONER'S DUTIES.] 
  2.15     Subdivision 1.  [DEPARTMENT CREATED.] The Department of 
  2.16  Game and Fish is created.  The commissioner of game and fish 
  2.17  shall manage the department and shall be appointed by the 
  2.18  governor under section 15.06. 
  2.19     Subd. 2.  [COMMISSIONER'S DUTIES.] The commissioner shall 
  2.20  have all charge and control of the taking of wild animals. 
  2.21     Subd. 3.  [RULEMAKING AUTHORITY.] Subject to chapter 14, 
  2.22  the commissioner may adopt, amend, and repeal rules relating to 
  2.23  any purpose, responsibility, or authorization in this chapter 
  2.24  and chapters 97B and 97C.  Rules adopted must comply with the 
  2.25  provisions of this chapter and chapters 97B and 97C that specify 
  2.26  or restrict the adoption of particular rules. 
  2.27     Sec. 4.  [TRANSFER OF RESPONSIBILITIES.] 
  2.28     The responsibilities of the commissioner of natural 
  2.29  resources relating to the taking of wild animals are transferred 
  2.30  to the commissioner of game and fish according to Minnesota 
  2.31  Statutes, section 15.039. 
  2.32     Sec. 5.  [CONFORMING CHANGES.] 
  2.33     The revisor of statutes shall prepare a bill for 
  2.34  introduction to the legislature by January 20, 2005, making 
  2.35  conforming changes in accordance with this act. 
  2.36     Sec. 6.  [REVISOR'S INSTRUCTION.] 
  3.1      The revisor of statutes shall change the phrase "Department 
  3.2   of Natural Resources" to "Department of Game and Fish" and the 
  3.3   phrase "commissioner of natural resources" to "commissioner of 
  3.4   game and fish" wherever the phrases appear in Minnesota 
  3.5   Statutes, chapters 97A, 97B, and 97C.
