  1.1                          A bill for an act
  1.2             relating to statutory cities; allowing statutory 
  1.3             cities to increase the membership of their public 
  1.4             utility commissioners; providing for staggered terms 
  1.5             of any additional members; amending Minnesota Statutes 
  1.6             1994, section 412.341, subdivision 1. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1994, section 412.341, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [MEMBERSHIP.] The commission shall consist 
  1.11  of from three to five members appointed by the council.  No more 
  1.12  than one member may be chosen from the council membership.  Each 
  1.13  member shall serve for a term of three years and until a 
  1.14  successor is appointed and qualified except that of the members 
  1.15  initially appointed in any city, one shall serve for a term of 
  1.16  one year, one for a term of two years, and one for a term of 
  1.17  three years, and any additional members shall serve initial 
  1.18  terms so that the terms of no more than two members expire in 
  1.19  any one year.  Residence shall not be a qualification for 
  1.20  membership on the commission unless the council so provides.  A 
  1.21  vacancy shall be filled by the council for the unexpired term.
