  1.1                          A bill for an act 
  1.2             relating to cruelty to animals; increasing the penalty 
  1.3             for certain mistreatment of animals; amending 
  1.4             Minnesota Statutes 1994, section 343.21, subdivision 9.
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1994, section 343.21, 
  1.7   subdivision 9, is amended to read: 
  1.8      Subd. 9.  [PENALTY.] A person who fails to comply with any 
  1.9   provision of this section is guilty of a misdemeanor.  A person 
  1.10  convicted of a second or subsequent violation of subdivision 1 
  1.11  or 7 within five years of a previous violation of subdivision 1 
  1.12  or 7, or of a first violation of subdivision 1 or 7 that results 
  1.13  in the mutilation, disfigurement, or death of an animal, is 
  1.14  guilty of a gross misdemeanor.  A person convicted of a second 
  1.15  or subsequent violation of subdivision 1 or 7 that results in 
  1.16  the mutilation, disfigurement, or death of an animal within five 
  1.17  years of a previous violation of subdivision 1 or 7 that 
  1.18  resulted in the mutilation, disfigurement, or death of an animal 
  1.19  is guilty of a felony.
