  1.1                          A bill for an act 
  1.2             relating to child care assistance; amending Minnesota 
  1.3             Statutes 2002, section 119B.03, by adding a 
  1.4             subdivision. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2002, section 119B.03, is 
  1.7   amended by adding a subdivision to read: 
  1.8      Subd. 11.  [MILITARY PERSONNEL.] Military personnel who 
  1.9   were receiving basic sliding fee child care assistance, or were 
  1.10  on a waiting list, before being activated but became ineligible 
  1.11  due to increased income from active military service retain 
  1.12  their position in the basic sliding fee program or on any 
  1.13  waiting list attained at the time of activation.  If they are on 
  1.14  a waiting list, they must advance as if they had not been 
  1.15  activated.  Military personnel leaving active military service 
  1.16  reenter the basic sliding fee program at the position they would 
  1.17  have occupied or the waiting list at the position to which they 
  1.18  would have advanced.  Military personnel who would have attained 
  1.19  eligibility for the basic sliding fee program must be given 
  1.20  assistance or advance to the top of the waiting list when they 
  1.21  leave active military duty.  At the time of deactivation, 
  1.22  increased income during the time of active military service must 
  1.23  be disregarded when calculating income under section 119B.09, 
  1.24  subdivision 4.  All other eligibility requirements under chapter 
  1.25  119B must be met in order to receive basic sliding fee 
  2.1   assistance. 
  2.2      [EFFECTIVE DATE.] This section is effective the day 
  2.3   following final enactment.
