  1.1                          A bill for an act 
  1.2             relating to metropolitan government; providing for 
  1.3             local zoning conformity in certain cases; amending 
  1.4             Minnesota Statutes 1994, section 462.357, subdivision 
  1.5             2. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 462.357, 
  1.8   subdivision 2, is amended to read: 
  1.9      Subd. 2.  [GENERAL REQUIREMENTS.] At any time after the 
  1.10  adoption of a land use plan for the municipality, the planning 
  1.11  agency, for the purpose of carrying out the policies and goals 
  1.12  of the land use plan, may prepare a proposed zoning ordinance 
  1.13  and submit it to the governing body with its recommendations for 
  1.14  adoption.  Except in the metropolitan area, as defined in 
  1.15  section 473.121, subdivision 2, and subject to the requirements 
  1.16  of subdivisions 3, 4 and 5, the governing body may adopt and 
  1.17  amend a zoning ordinance by a two-thirds vote of all its 
  1.18  members.  In the metropolitan area, subject to the requirements 
  1.19  of subdivisions 3, 4, and 5, the governing body may adopt and 
  1.20  amend a zoning ordinance by a majority vote of all of its 
  1.21  members.  Except for local governments in the metropolitan area 
  1.22  as provided in section 473.858, subdivision 1, if the 
  1.23  comprehensive municipal plan is in conflict with the zoning 
  1.24  ordinance, the zoning ordinance supersedes the plan. 
  1.25     Sec. 2.  [APPLICATION.] 
  2.1      Section 1 applies in the counties of Anoka, Carver, Dakota, 
  2.2   Hennepin, Ramsey, Scott, and Washington. 
  2.3      Sec. 3.  [EFFECTIVE DATE.] 
  2.4      Sections 1 and 2 are effective the day after their final 
  2.5   enactment.
