1.1 A bill for an act 1.2 relating to education; modifying the membership of the 1.3 Commission on National and Community Service; 1.4 modifying program training; changing appropriation 1.5 figures; amending Minnesota Statutes 2003 Supplement, 1.6 sections 124D.385, subdivision 2; 124D.42, subdivision 1.7 6; Laws 2003, First Special Session chapter 9, article 1.8 6, section 4; repealing Minnesota Statutes 2002, 1.9 sections 124D.41; 124D.42, subdivisions 1, 2, 4, 5, 7; 1.10 124D.43; Minnesota Statutes 2003 Supplement, section 1.11 124D.42, subdivision 3. 1.12 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.13 Section 1. Minnesota Statutes 2003 Supplement, section 1.14 124D.385, subdivision 2, is amended to read: 1.15 Subd. 2. [MEMBERSHIP.] (a) The commission consists of 1.161825 voting members. Voting members shall include the 1.17 commissioner of education, a representative of the Children's1.18Cabinet elected by the members of the Children's Cabinet, and1.19the executive director of the Higher Education Services Office. 1.20 (b) The governor shall appoint15nine additional voting 1.21 members. Eight of the voting members appointed by the governor1.22shallthat include a representative ofpublic or nonprofit1.23 organizations experienced in youthemploymenteducation, 1.24 development and training, organizations promoting adult service 1.25 and volunteerism, community-based service agencies or 1.26 organizations, local public or private sector labor unions, 1.27 local governments, business, a national service or service 1.28 learning program,andIndian tribes, and an individual between 2.1 the ages of 16 and 25 who is a participant or supervisor in a 2.2 program. The remainingseven15 voting members appointed by the 2.3 governor shall includean individualindividuals with expertise 2.4 in theeducational, training, and development needs of youth,2.5particularly disadvantaged youth; a youth or young adult who is2.6a participant in a higher education-based service-learning2.7program; a disabled individual representing persons with2.8disabilities; a youth who is out-of-school or disadvantaged; an2.9educator of primary or secondary students; an educator from a2.10higher education institution; and an individual between the ages2.11of 16 and 25 who is a participant or supervisor in a youth2.12service programmanagement and operations of a nonprofit 2.13 organization, including individuals with expertise in public 2.14 relations, finance, and development. 2.15 (c) The governor shall appoint up to five ex officio 2.16 nonvoting members fromamong the following agencies or2.17organizations: the Departments of Economic Security, Natural2.18Resources, Human Services, Health, Corrections, Agriculture,2.19Public Safety, Finance, and Labor and Industry, the Housing2.20Finance Agency, and Minnesota Technology, Incappropriate state 2.21 agencies. A representative of the Corporation for National and 2.22 Community Service shall also serve as an ex officio nonvoting 2.23 member. 2.24 (d) Voting and ex officio nonvoting members may appoint 2.25 designees to act on their behalf. The number of voting members 2.26 who are state employees shall not exceed 25 percent. 2.27 (e) The governor shall ensure that, to the extent possible, 2.28 the membership of the commission is balanced according to 2.29 geography, race, ethnicity, age, and gender. The speaker of the 2.30 house and the majority leader of the senate shall each appoint 2.31 two legislators to be nonvoting members of the commission. 2.32 Sec. 2. Minnesota Statutes 2003 Supplement, section 2.33 124D.42, subdivision 6, is amended to read: 2.34 Subd. 6. [PROGRAM TRAINING.](a)The commission must, 2.35 within available resources, ensure an opportunity for each2.36participant to have three weeks of training in a residential3.1setting. If offered, each training session must: 3.2 (1) orient eachparticipantgrantee organization in the 3.3 nature, philosophy, and purpose of the program; 3.4 (2) build an ethic of community service through general 3.5 community service training; and 3.6 (3) provide additional training as it determines necessary, 3.7 which may include training in evaluating early literacy skills 3.8 and teaching reading to preschool children through the St. Croix 3.9 River Education District under Laws 2001, First Special Session 3.10 chapter 6, article 2, section 70, to assist local Head Start 3.11 organizations in establishing and evaluating Head Start programs 3.12 for developing children's early literacy skills. 3.13(b) Each grantee organization shall also train participants3.14in skills relevant to the community service opportunity.3.15 Sec. 3. Laws 2003, First Special Session chapter 9, 3.16 article 6, section 4, is amended to read: 3.17 Sec. 4. [APPROPRIATIONS.] 3.18 Subdivision 1. [DEPARTMENT OF EDUCATION.] The sums 3.19 indicated in this section are appropriated from the general fund 3.20 to the department of education for the fiscal years designated. 3.21 Subd. 2. [BASIC SYSTEM SUPPORT.] For basic system support 3.22 grants under Minnesota Statutes, section 134.355: 3.23$8,072,000$8,312,000 ..... 2004 3.24 $8,570,000 ..... 2005 3.25 The 2004 appropriation includes $1,456,000 for 2003 and 3.26$6,616,000$6,856,000 for 2004. 3.27 The 2005 appropriation includes$1,654,000$1,714,000 for 3.28 2004 and$6,916,000$6,856,000 for 2005. 3.29 Subd. 3. [REGIONAL LIBRARY TELECOMMUNICATIONS AID.] For 3.30 regional library telecommunications aid under Minnesota 3.31 Statutes, section 134.355: 3.32$1,200,000$960,000 ..... 2004 3.33 $1,200,000 ..... 2005 3.34 The 2004 appropriation includes $960,000 for 2004. 3.35 The 2005 appropriation includes $240,000 for 2004 and 3.36 $960,000 for 2005. 4.1 Subd. 4. [MULTICOUNTY, MULTITYPE LIBRARY SYSTEMS.] For 4.2 grants according to Minnesota Statutes, sections 134.353 and 4.3 134.354, to multicounty, multitype library systems: 4.4 $876,000 ..... 2004 4.5 $903,000 ..... 2005 4.6 The 2004 appropriation includes $153,000 for 2003 and 4.7 $723,000 for 2004. 4.8 The 2005 appropriation includes $180,000 for 2004 and 4.9 $723,000 for 2005. 4.10 Subd. 5. [ELECTRONIC LIBRARY FOR MINNESOTA.] For statewide 4.11 licenses to on-line databases selected in cooperation with the 4.12 higher education services office for school media centers, 4.13 public libraries, state government agency libraries, and public 4.14 or private college or university libraries: 4.15 $400,000 ..... 2004 4.16 $400,000 ..... 2005 4.17 Any balance in the first year does not cancel but is 4.18 available in the second year. 4.19 [EFFECTIVE DATE.] This section is effective the day 4.20 following final enactment. 4.21 Sec. 4. [REPEALER.] 4.22 (a) Minnesota Statutes 2002, sections 124D.41; 124D.42, 4.23 subdivisions 1, 2, 4, 5, and 7; and 124D.43, are repealed. 4.24 (b) Minnesota Statutes 2003 Supplement, section 124D.42, 4.25 subdivision 3 is repealed.
