  1.1                          A bill for an act 
  1.2             relating to family and early childhood education; 
  1.3             changing the allocation formula for basic sliding fee 
  1.4             child care assistance; providing that a repeal is 
  1.5             without effect; amending Minnesota Statutes 1996, 
  1.6             section 119B.03, subdivision 7, as amended.  
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1996, section 119B.03, 
  1.9   subdivision 7, as amended by Laws 1997, chapter 162, article 4, 
  1.10  section 14, is amended to read: 
  1.11     Subd. 7.  [ALLOCATION EXCEPTION.] For the period from July 
  1.12  1, 1997 1998, to December 31, 1998, each county must receive an 
  1.13  amount equal to its original calendar year 1997 allocation.  The 
  1.14  remaining funds must be allocated according to the following 
  1.15  formula: 
  1.16     (a) Two-thirds One-third of the funds must be allocated in 
  1.17  proportion to each county's original calendar year 1997 
  1.18  allocation for the basic sliding fee program. 
  1.19     (b) One-third Two-thirds of the funds must be allocated in 
  1.20  proportion to each county's most recently reported waiting list 
  1.21  as defined in section 119B.03, subdivision 2. 
  1.22     When funding increases are implemented within a calendar 
  1.23  year, every county must receive an allocation at least equal and 
  1.24  proportionate to its original allocation for the same time 
  1.25  period.  The remainder of the allocation must be recalculated to 
  1.26  reflect the funding increase and according to the formulas 
  2.1   identified in subdivision 6 and this subdivision. 
  2.2      Sec. 2.  [REPEALER WITHOUT EFFECT.] 
  2.3      The repeal of section 119B.03, subdivision 7, by Laws 1997, 
  2.4   chapter 162, article 1, section 19, is without effect and 
  2.5   section 119B.03, subdivision 7, remains in effect after June 30, 
  2.6   1997, as amended by Laws 1997, chapter 162, article 4, section 
  2.7   14.  
  2.8      Sec. 3.  [EFFECTIVE DATE.] 
  2.9      Section 1 is effective July 1, 1998.  Section 2 is 
  2.10  effective July 1, 1997.
