  1.1                          A bill for an act 
  1.2             relating to education; increasing the authorized 
  1.3             amount expected to be earned from an employment 
  1.4             contract between a school board member and a school 
  1.5             district; amending Minnesota Statutes 2002, section 
  1.6             123B.195. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 123B.195, is 
  1.9   amended to read: 
  1.10     123B.195 [BOARD MEMBERS' RIGHT TO EMPLOYMENT.] 
  1.11     Notwithstanding section 471.88, subdivision 5, a school 
  1.12  board member may be newly employed or may continue to be 
  1.13  employed by a school district as an employee only if there is a 
  1.14  reasonable expectation at the beginning of the fiscal year or at 
  1.15  the time the contract is entered into or extended that the 
  1.16  amount to be earned by that officer under that contract or 
  1.17  employment relationship will not exceed $5,000 $8,000 in that 
  1.18  fiscal year.  Notwithstanding section 122A.40 or 122A.41 or 
  1.19  other law, if the officer does not receive majority approval to 
  1.20  be initially employed or to continue in employment at a meeting 
  1.21  at which all board members are present, that employment is 
  1.22  immediately terminated and that officer has no further rights to 
  1.23  employment while serving as a school board member in the 
  1.24  district. 
  1.25     [EFFECTIVE DATE.] This section is effective July 1, 2004.
