  1.1                          A bill for an act 
  1.2             relating to environment; providing that notice must be 
  1.3             given or reasonable compensation paid to a solid waste 
  1.4             collector for displacement of the collector's 
  1.5             business; amending Minnesota Statutes 2000, section 
  1.6             115A.94, by adding a subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 115A.94, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 8.  [FIVE YEARS' NOTICE OR REASONABLE 
  1.11  COMPENSATION.] Notwithstanding subdivision 7, if any portion of 
  1.12  a solid waste collector's business will be displaced by 
  1.13  organized collection, the local unit of government that 
  1.14  initiated the organized collection must provide five years' 
  1.15  notice to the collector before the local unit of government 
  1.16  engages in the actual provision of the service that displaces 
  1.17  the waste collector's business.  As an alternative to delaying 
  1.18  displacement for five years, a local unit of government may pay 
  1.19  reasonable compensation to the collector for the business that 
  1.20  will be displaced when organized collection begins.  "Reasonable 
  1.21  compensation" means an amount equal to the displaced solid waste 
  1.22  collector's preceding 24-months' gross receipts for the business 
  1.23  that is displaced.
