  1.1                          A bill for an act 
  1.2             relating to retirement; teachers retirement 
  1.3             association; granting an exemption from the reemployed 
  1.4             annuitant earnings limitation for certain interim 
  1.5             superintendents. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [TEACHERS RETIREMENT ASSOCIATION; REEMPLOYED 
  1.8   ANNUITANT EARNINGS EXEMPTION FOR CERTAIN SCHOOL DISTRICT INTERIM 
  1.9   SUPERINTENDENT.] 
  1.10     Notwithstanding any provision of Minnesota Statutes, 
  1.11  section 354.44, subdivision 5a, to the contrary, a person is 
  1.12  exempt from the earnings limitations and reductions in annuity 
  1.13  payments as provided in Minnesota Statutes, section 354.44, 
  1.14  subdivision 5, for the period of February 6, 1996, through June 
  1.15  30, 1996, if the person: 
  1.16     (1) served as the interim superintendent for independent 
  1.17  school district No. 846, Breckenridge, on January 1, 1996; and 
  1.18     (2) was previously granted an exemption from the earnings 
  1.19  limitations and reductions in annuity payments as an interim 
  1.20  superintendent for the Breckenridge school district under 
  1.21  Minnesota Statutes, section 354.44, subdivision 5a, because of 
  1.22  the illness of the prior regular superintendent; and 
  1.23     (3) then discontinued service as an interim superintendent 
  1.24  upon the return to service of the prior regular superintendent, 
  1.25  and who again returned to service as an interim superintendent 
  2.1   upon the death of the prior regular superintendent. 
  2.2      Sec. 2.  [EFFECTIVE DATE.] 
  2.3      Section 1 is effective February 6, 1996.
